Refund on wedding deposit

BLASDELL, NEW YORK -- We put down a $1000 deposit for our daughters wedding which was cancelled due to personal reasons. We cancelled 6 months in advance and wrote them a letter explaining the reasons for the cancellation after being told via a phone call that they needed a letter. We haven't heard from them and I'm sure they have rebooked the Avanti Mansion and received another $1000 deposit. I was asking for at least part of the deposit back but the owner is very unpleasant and I would not recommend having a wedding there.

How do you know they have another deposit? What does your contract say about the deposit? Most of the time they are nonrefundable because they have closed the date that you requested and can not book it for something else. Maybe if they do get someone else for the date you will get your deposit back.

A nonrefundable deposit is a nonrefundable deposit. I highly doubt a wedding Banquet hall would take refundable deposits. It just wouldn't be good business sense.

So while it would be nice for them to refund your deposit, they are not obligated and it's possible that they aren't able to re-book the date with another person. That's the reason for the nonrefundable part.

Sounds like there's been a lot of fallout from this wedding cancellation. At some point, the kids who cancelled the wedding have to take responsibility for the fallout.

That being said, the law is not particularly fond of windfalls. That means that if this company has a $1k deposit from you and rents the same space for the same day at the same or higher cost, the law isn't going to be really fond of them keeping the deposit. Unfortunately, to get to that analysis, you'll have to go to small claims court. Good luck!

Goduke, the OP is assuming that they have already rebooked, there really is no proof. If there is proof then the OP can bring them to SCC and get a refund.

My wife and I put down a deposit last year for 1600.00 dollars at the Clubhouse at Patriot Hills. we had to cancel a few weeks later and was informed by the establishment that we would get our money back if someone else reserves the date. The best thing to do if you are not informed is to go on the date of your scheduled wedding. I went the date of our wedding and to my surprise was informed another function was taking place at the same time and date as our reserved wedding. When I asked about our refund all I received was rudeness and unprofessional manner and was told to just get a lawyer. To add to insult they asked for my copy of the lease and when I asked for it back the manager told me I was not allowed to come and pick it up. (lucky I had a copy). They were totally caught off guard of me showing up and their rude and threatening manner proved it.
