LIVERMORE, CALIFORNIA -- If you are in default with student loans and Diversified Collection Service calls you suggesting a rehabilitation program to stop the IRS from taking your tax refund.....do not believe one word they say and hang up immediately. They will lie and abuse you verbally, take your money, and still your tax refund will be offset. This company has numerous lawsuits and class action suits against them.

They have an unsatisfactory rating with the BBB of northern California. Contact the Dept. of Education about their tactics immediately.

Let me take a wild guess here, American's gave you money for your education and now you don't (or can't) pay it back? What is the mind set that says borrow money to get a degree from the American Government but tell them to go pound sand when it comes time to pay it back? You got your loan, you probably got your education, now Diversified Collection Services are a bunch of crooks because they are trying to get you to pay back something you agreed to pay? Beyond me, I want some free money too!

They should add 10% onto your balance each time you hang up on them!
You didn't say WHY you haven't paid them...people can usually get a deferment on a student loan until they find a job. But if you just ignore it, then there is nothing anyone can do for you.

Op, why haven't you paid back your student loan?? Are hoping that after the ten years pass that they allow for repayments, they will simply forget you??

You will get your income refunds intercepted if you don't pay back your student loans. Uncle Sams ain't playing games anymore.

Just read all the documents you signed while in the process of aquiring your student loan.

Thanks Ponie, these people trying to beat paying back the student loans really get to me. The best ones are the foreign students that get the loans then return home leaving us holding the bag for their education.

I suppose I didn't make myself clear. Daughter got the loan and has repaid 3400.00 of it. She then had a c-section with severe complications requiring hospitalization for several weeks. Never completed her schooling, is now working and entered a contract with this debt collection agency making regular monthly payments in order to take care of the remaining $3000.00. DCS informed her that this rehabilitation program would allow her tax refund to be given to her, providing she makes on time payments. she chose to have it automatically deducted from her account to be sure they are on time.....and they are offsetting her taxes anyway and DCS claims they never told her this would not happen. I have a copy of the letter stating that with this payment contract, no further collection procedures would be enacted. She is not trying to get free money...just a reasonable and honest repayment plan!!!!!!

Can you help her out until she can get on her feet? I had two kids myself, and I realize there were complications, but it's still not an excuse to not pay your bills.

First of all, I work for DCS, and I consider myself a very understanding person. I do my job in a respectable manner and have never overstepped my boundries and lied or abused any of the debtors I have come in contact with...(although I could say something different about a few of them)Secondly the hard-luck story does not excuse the debt you owe to the federal government, or the fact that you signed an agreement promising to pay the debt in full should it ever come to a default status. The circumstances may be unfortunate, but it's life and we all carry responsibility. Anything less than paying the balance in full (such as the rehab program) is special consideration and is a favor. Technically the calls we make are "courtesy calls", all it takes is a breach in your contract and a few letters home, and you are subject to wage garnishment and tax seizures. It is not a matter of people out to get you or the government trying to bully anybody, the simple fact is you owe $$ and it needs to be repaid. It is unfortunate if you feel harassed, that should never be the issue, but no one can be held responsible except yourself. The truth is...we are just doing our jobs, so should you.

Shame on all of you. How dare you chastise someone for being upset at harrassing, rude, inappropriate, threatening, moronic, hateful, illegial, and I could go on ad nauseum phone calls. DCS is EVIL. The woman who claims she is an employee should be ashamed of herself - just doing her job - my foot. DCS does not follow the rules and procedures of the FCTA. None of you have the right to comment unless you are in the person's shoes. Just wait - pretty soon DCS will find a reason to call of you and harrass you. DCS deserves no cooperation from anyone. Ask the poster who works for them how much she received in bonuses from the harrassment of her fellow man. Keep hanging up on DCS and tell them just where they can stick themselves.

WOW!!! What a heartless bunch of cronies. May you never experience the wrath, lies, deceit, and harrassment of collection agents. Yes, someone may own the money, but NO ONE deserves to be treated with disrespect, foulness, or threats and until you yourself have experienced it, keep your comments to your self.

I couldn't agree more with you Tarahrah. My position is I never got to finish my education because of terminal health problems. I will never be able to attend school or get my degree, or work again. With the way the economy is going, SSD is NOT a living wage/income. Yes, I worked for many years and paid into the Social Security system. I am being paid benefits that are rightly mine.

Collection agents are pigs. My insulin cost $498.00 and the collection agent said she didn't care how much it was and that I should stop buying insulin and pay my loan.

Was I shocked??? Don't we ALL know what happens when a diabetic stops their insulin? We DIE, then how the heck are they going to collect on a measly $3,000.00 student loan. Don't even suggest a prescription assistance program. I've already been down that route.

Why the heck am I getting a notice now? Another indication of why we get so upset about things. BTW....the loan is paid off and I pray I never have to deal with the government or debt collectors again. People have to be hard up for money to do that job.....I hope they are satisfied with their pay.....

Well......all I can say is that some of these posts are dead on and some just don't understand. From my experience, I haven't been rudely harrassed or threatened or anything like that, but I HAVE had my problems with this company. Mainly, after setting up the rehab loan program with them, I was paying regularly and nearing the end of the term when I called and discussed a payment (March) that I would need to be late on. That wasn't a problem for them except that the next payment would be late as it was a two week timeframe and thy worked it out with me that the next payment wouldn't be due then until the following month. I gave them my late payment and then I come to find out that they took the next payment ANYWAY the very next week after they "said" that the account was notated to the contrary. The REAL problem that I had was that that payment caused my car note, and mortgage then to be late as well! All I wanted was for them to refund the payment that wasn't supposed to be taken out so my other bills would be cool. They said that they could not do that! Why?.....If you are able to access my funds to GET the money, why can't you use the same electronic access to REFUND the money in question? Turns out that after extensive arguement with a supervisor, I agreed that the faulted payment would count as the April payment so I didn't need to pay at all the month of April, and I would pay for May....today May 15! While that was acceptable to me and I worked out the other bills that went a wry, when I called the supervisor (Lisa Davis) yesterday AND today to make the payment wth "her and only her" which I was instructed to do, I have received NO CALL BACK after leaving 3 voicemails and it is getting near to the end of the day. Watch.....she will not call me back and then I will "default" which I then will be extremely LIVID!!!!! I am making a valiant attempt to get this off of me!

My belief is that all debt collectors are basically the same....they will do whatever they want to make you pay extra charges. If they were a loan company, the interest rate would be illegal. It's a shame this is allowed to go on, especially now. Let them go back to what was originally owed, and make payment arrangements. There is no way the "paper work" costs 30 or more dollars a month. If someone had the money to pay in the first place, they would have paid it (most of them), to expect them to pay 10 times what they originally owed is ridiculous!

Just received a phone call from DCS. I am not a client, I have my student loans consolidated through my local bank, and pay them off monthly. I have never been involved with a debt collector, so this was unexpected.
A "Danielle," who refused to identify the company she was with when asked, tried to secure my address. When I refused to answer until she told me who she was with, she asked if I knew my neighbors, "Chris and Kim" who she was trying to get a hold of. I asked if she was family, which she denied. I asked if this was a collections agency, which she did not answer. I then asked to speak with her manager, and she hung up. When I called back, I was connected to a female manager who refused to identify herself. When I asked where she got my personal, unlisted information and why she called me for information regarding my neighbors, she laughed and told me to "deal with it" before hanging up.
I believe everyone should pay back what they borrow, but there needs to be a limit to what lengths these bottom-feeders can do to obtain information.

Wow, I just rehabilitated my loan through DCS, they don't have the best customer service skills but I haven't found anything they have explained to me to be untrue. I made my 9 payments on time with an initial downpayment that included whatever fee they required. But at the end of the process my student loan is no longer in default, the department of treasury isn't after my tax refund and I've made an accomplishment that those hard asses helped me with:)

Threatening Collection Calls

MICHIGAN -- I can appreciate any honest persons attempt to collect a debt; HOWEVER, when people make threats and cross the line for what is legally acceptable, something needs to be done. There are laws that govern what a collection agent can and can't do and these people, both men and women in this office, totally disregard all legal protocols when making comments about peoples family's and threatening clients. This is no joke and it is not an emotional response. Our circumstances are such that I can't pay my owed bill at this time, but fully expect to pay it hopefully soon. Just because I can't pay immediately doesn't mean I won't pay at all. I am very familiar with the laws an agent must abide by and these people have never read the book.

My advice, record their calls and keep an "air horn" like the ones used on a boat near the phone and when they tell your wife to go "hook" on a corner to pay your bill... BLAST THEM! Good luck with your hardship.

When we lived in Virginia Beach we used to get collection calls for the person who previously had our phone number. I got so fed up with them calling at all hours of the day and night I blew a police whistle into the phone.

Great info Duke, good ideas too. Keep recording the calls and if they make any specific threats(i.e. harmfull ones) then go straight to the police with the tape. Good luck.

Collection of Cell Phone Fees

COON RAPIDS, MINNESOTA -- My complaint about this collection agency I phoned in to let them know that the recipient of the past due bill past away. I gave them specifics of the death and informed them the death is not officiated by the county yet because I am still awaiting results from the toxicology report. I informed them, the only official document I had was the obituary. The collection rep responded with a nasty response by saying who cares, no one cares your brother died and hung up the phone. I called back 5 minutes later to speak to a manager but I had a difficult time getting connected to one. The second rep was getting an attitude after I explained my story and told me know one would be able to help me. He stated I was wasting my time. I am could not believe what was happening. I told him to please connect me to a manager and he hung up the phone on me.
I would like everyone to know about this company. I was providing them with a courtesy call and all I got was crap from people who call themselves collection reps.

Sorry about your brother, but would you believe it if someone called you and told you the person that owed you money is dead - althought it can't be proven - and for you to just go away and forget about your money? Sure they could be nicer, but they are collection agents. Don't worry about them right now - you tried.

My condolences. The executor (or executrix as the case may be) will be responsible for settling any debts. If your brother did not leave a will then a representative will be appointed by a probate court. If you have an answering system use it to screen all calls. When they call again you simply press erase.

Sorry also for your lose. I would not provid them with the time of day much less a courtesy call. All you will ever get from them is crap. They don't care and they think you are liying you don't owe them anything!

Collection Tactics

My sister has numerous student loans that have been dismissed due to a permanent disability. She had several through Citicorp and DVS now holds the loans. My mother cosigned on one 4000 dollar note and has been paying on it. DCS has now totaled all of my sisters outstanding debts and they are telling my Mom that she is responsible for all of them and if she does not pay 32,000 dollars in the next 48 hours, they will take all of her possessions and put her out on the street. My mother is 70 years old and lives on a fixed income of $750 per month. Her house is paid for but she barely has enough to make ends meet. DVS is trying to make her pay for loans that she did not cosign on. She was going to do a reverse mortgage and send this company 32,000 to get them to quit harassing her.

This company will not provide any documentation of her signature on the 7 loans in question.

You need to intervene and help your mother on this. Draft a standard cease communication letter declaring they officially are notified they are to no longer contact you (her) by telephone regarding these debts. Have her sign it and send it certified. If they continue to call her, they are in violation of the law and can be sued in civil court. You can also file a complaint with the FTC should they ignore the C&D letter.

Contact your state's Office of the Attorney General as well.

They are not entitled to payment for loans that have been dismissed, let alone from a person who was never responsible for them. And they are certainly not allowed to make threats like that which they are obviously not allowed to legally follow through on.

LIVERMORE, CALIFORNIA -- I requested they take me out of wage garnishment so I could consolidate all my loans they refused. Direct loans would pay the entire loan off to them so I could consolidate, Monica Hall stated they wanted more money from me and would not help until I put more money out than they are already getting. I don't make that much and have a child I only support. I owe out to both the state and local taxes and they expected me to shell out more money. She then got nasty and hung up. This has been going on for 7 years.

All I wanted was to consolidate, they are a terrible company. Who ever put them in charge is an evil hateful person. How do you get ahead if they won't help?

You can consolidate your loans and include the total amount of the garnishment. They're not going to stop the garnishment so that you can get your act together about a consolidation loan, because if you decide not to do it they're stuck without a way to collect. How does this make them criminals?

Oh I'm sorry didn't I say that Direct Loans pays them in full? That is how it is when you transfer from one bank to another. One bank pays off the other so you can get a lower rate.
