Cancellation of Customer Care Package

GULFPORT, MISSISSIPPI -- I purchased furniture from Rhodes, Inc. on May 19, 2005. On August 29, 2005 the furniture was destroyed in hurricane Katrina. As this was less than 4 months from purchase, the 60 month extended care package had not gone into effect.
I notified Rhodes, Inc. and Assurant Solutions the extended warranty provider in Nov. 2005 of the loss of the furniture and sought the release of the extended care package. It was never done!!

At present in 2007, I am being harassed by Rhodes, Inc. on a daily basis wanting to collect the $221.21 for the customer care package, that was never in effect and therefore should not be paid.

Many letters and phone calls have not solved this dilemma!!

Rhodes went out of business last year and Rooms to Go bought some of their assets. According to their website there is a number (888-539-4341) to call about their extended warranties. Might be worth a try. Good luck.

This is going to sound bad…

Unless the service agreement/contract has an escape clause for natural disaster that releases you from the debt obligation, you are legally responsible for the debt.

I had a friend with similar situation. His car was destroyed when a large tree fell on it. After the insurance settlement, he still own $5 K on the auto loan. The bank sues and won the judgment on the remainder of the loan.

HJB is right... the value of the extended care should have been rolled into the value of teh furniture in your insurance claim.

read the contract very closely. I am betting a dollar to a donut you will find the words, "Act of god," in there somewhere. Last time I checked, they consideered a hurricane an 'Act of God.'

In all fairness, I would expect the warranty issuer to cease collections. This is an noncollectable debt. It's not a slam dunk for them in court and it certainly isn't worth them even trying. I'd tell Rhodes flat out I have no intention under the circumstances of paying it and to take me to court and explain in front of a judge why I, who lost the furniture plus who knows what in the costliness storm in US history, have to accept this warranty is valid on nonexistent furniture.

I agree with all post here and this is a hard one. But starlord has a very good point and you should check the contract closely.

Example: A Contract has a provision that allows the buyer to Default if the property is damaged by an act of God.
Examples of an act of God are:
• earthquake
• flood
• hurricane
• lightning
• tornado

Yup, natural disasters usually void most contracts, unless as Lidman says, there is a provision.

Customer Service That Isn't

MORROW, GEORGIA -- Over the years, we've spent thousands of dollars at Rhodes, and always have been treated well. Recently, however, we had an experience which has led us to abandon Rhodes as our furniture store of choice.
We purchased bedding from Rhodes less than one year ago. Although we turn the mattress frequently, both my wife and I are unhappy with the way our mattress has begun to sag. We phoned our local Rhodes store for assistance. They sent someone out to examine the bed. He did some sort of 'measurement' with a weighted string, and informed us that our bed 'meets specifications.'
We told him it didn't meet OUR specifications.
I talked with the manager of our local Rhodes store (Mt Zion store), and told him all we wanted was a nice firm, FLAT surface to sleep on. He told me there was nothing he could do to make us happy.

So...to make us happy and keep us as satisfied Rhodes customers, we'd simply like you to replace our bedding.

At the very least I would like a response from your company regarding this incident. Thank you for your time.
