Bank of America Informative - Trying To Rip Us Off - Mortgage Payments
For several months, Bank of America has been saying we are behind on our mortgage. I received a statement for Sept. It said: Hone loan payment due on 09/01/2011...1170.33 Then it said: Past due payment amount 770.33. Payment due Sep 1, 2011 1,170.33. I went to a local branch, handed them my summary, paid 1170.33 and today we get a check from Bank of America stating they are returning 369.19 for a check I wrote; that it was not a full payment. I made my payment in cash and now they're returning 369.19 of it. I don't know what they are up to and don't trust them. Tomorrow I am calling my attorney at "Legal Shield", formerly Pre-Paid Legal services and finding out my rights. I've been trying to straighten this out with them for several months. I get my call dropped and it takes forever to get another human. They said I missed my October payment, so, even though I think they're wrong, we decided just to start paying what the amount due said. The 369.19 is not even the real difference between the 1170.33 and my usual payment of 770.33. I've tried to match figures up with the escrow and insurance, deducting this amount and can't come up with where they got the amount on the check they sent me. I'm very mad at them. You do not walk into a local branch of Bank of America and talk to a mortgage dept because they don't have one. You can only talk on the phone, if you're lucky enough to get to a human. I want to know who governs banks and what I can do about this. I repeat, I'm calling an attorney tomorrow. I've always heard that if you owe a debt and pay on it, if the creditor refuses your payment, you don't owe them anymore. Of course, this is probably wrong.
