Marriot International Complaint - Handicapped Discrimination

Review by tj-sj39 on 2011-10-13
BETHESDA, MARYLAND -- Marriot harbour point in Hilton. 4 week time share owner. discrimatory smoking policy. I had my first unpleasant experience at a marriot timeshare. no smokimg was allowed in the 5 acre campus except for two areas that that had no signs identifying them no smoking policy was provided on check in. smoking signs were posted in the rooms. smoking signs on the balcony were not posted. smokiing signs were posted no where outside of the rooms. there were no smoking rules on the pool deck even though numerous rules were listed. whn I compained I was given the brochure page which indicated that no smoking was allowed in the room or on the balcony. here was no mention of no smoking on the remainder of the campus. THEI WAS NO ACCOMODATION FOR HADICAPPED SMOKERS AND I WAS TOLD THAT THEY WOULD HAVE TO WALK UP TO 300 YARDS TO A SMOKING AREA. I FEEL THAT THIS IS A DISCRIMITORY POLICY.

You are fighting a loosing battle, according to SCOTUS, it's impossible to discriminate against a smoker.

Consider giving your feedback to corporate, and at the least, suggest they make the smoking policy clearer.

Smoking is not a handicap, it is a choice. Unfortunatly they are not going to help you. In fact most local laws now state you have to be a certain amount away from a public area to smoke so they may legally not be able to change it

I think the OP means that he is both handicapped AND a smoker. Somehow, I doubt access to smoking areas is covered under the ADA. But, I could be wrong.
