FALLBROOK, CALIFORNIA -- My wife and I were in Arizona when we were hit by a white SUV driven by a 16 year old girl on the fourth day of driving with her new licence. The problem is the finding that I am 100% at fault. I was not "at fault" in any way. The GMAC agent who is in charge of my claim Will not give any reason why I am at falt except to say that I failed to yield the right of way...No clue as to what information brought her to this conclusion or how I should yield the right of way to someone who hit me and ran her car up the right side of mine while I was in My Own Lane. Hit rear to front...on a one lane road???????? I want to change Insurance company but with the 100% at fault...I can't. And you better believe the know it.

It usually goes by the police report and tickets that were issued. Who got a ticket?

I had the same question as to if a ticket was issued. If no police report was made and no ticket was issued, it is generally up to the insurance companies to sort things out. If your own insurance company concluded that you were at fault, there must be a reason.
