PriceBreak.com Complaint - Deceptive advertiseing and satement lies about products they offer

BROOKLYN, NEW YORK -- On Dec 10, 2011 I called PriceBreak.com at 1-888 430 4646 and told the sales person ( I have the name ) I was interested in buying a new Garmin nuvi 3790T they were adveriseing for $276.90 on the internet. I asked if they had and in stock ready to ship, the answer was yes how many do you want?. I asked if the unit was new and in the original sealed box, the answer was yes with a one year warranty. At that point I printed a copy of the advertisment and placed the order for one and gave my credit card information. They sent be an e-mail confirmation citeing all the above, which I also printed. (Not new and no warranty ) I will consider litigation.

A few days later (12/13/2011) I called and aked for the tracking number and asked him to confirm that the unit was new with a one year warranty. He hesitated, and then said the product is not new, but refurbished like new. I complained then Mgr came on and said I can send it back if I like.

They will also try to suggest that they did not advertise as new when in fact they will change the internet posting in subtle ways like adding an r after the model number.

This does sound shifty. Try filing a complaint with the NY consumer protection agency (along with your possible litigation) at: http://www.dos.ny.gov/consumerprotection
