Comcast/xfinity - Refund to a deceased man

CALIFORNIA -- My father died in feb.2012.i canceled his account and returned his equipment. I was told he was due a refund and the check would be sent in my name. i came in my dead fathers name. I called them and told them I could not cash it unless it was in my name. I was assured it would be reissued in my name it came issued to my fathers estate. i again called them this time I was told they could not issue it in my name even though I am the exceture of his will and that there is no probate or estate due to the small amounts of money involved. they still refused. so I am left with a worthless check from Comcast and wondering how many people they due this to. it all adds, up so how much money are they keeping thats not theres.

When my mom died I opened an estate checking account to handle stuff like this.

I could not get checks made out to me personally - Comcast has no way of knowing that the estate consists of you only, or in the alternative that you will split it accordingly with other heirs.

The only thing would be if they were willing to accept a copy of the will and the death certificate, but it sounds like they won't do that. I don't think this is Comcast's fault - to not skirt the rules regarding a decedant. I don't believe they do this to make money.

When my mother died an account was set up with her name..estate. I didn't get personalized checks but used those temporary ones provided by the bank and typed in the information at the top for any payments due. There were a few deposits after her death and a few checks written. The checks were in her name only but there was no problem whatsoever depositing them into the account. Most will recommend you do this and since you set the account up there is no problem at all getting the money. At least it was not in my case when the time came to close it.

You will probably have to file an income tax return on behalf of your father for the year 2012. Most banks are pretty understanding and won't charge anything for those types of accounts. You might still want to look into it.

Our credit union allows us to deposit checks made out to other people into our account, no signature is required. Once the check clears the money is ours to do with as we wish. Check with your bank to see if they allow anything such as this.

Comcast is heavily regulated by the FCC. The FCC will not allow a refund to be sent to a 3rd party even with a death certificate . The check has to be issued to the deceased and deposited into the estate account, Then the estate can divvy it up to pay bills owing from the deceased. THEN ( and only then) can any funds to heirs be distributed. No funds legally can be distributed until all bills of the estate and deceased are paid.
