Safeco Insurance - Coverage Is a Joke

CORPUS CHRISTI, TEXAS -- I was hit by a 2x4 that fell out of a truck hitting me while I was riding down the road. The board broke 4 bones in my leg and foot. The truck did not stop. Safeco say this is not covered under hit and run because the truck did not hit me. I have lost 6 weeks of work and around 20,000 dollars. I have been with them for 4 years and have never missed a payment but when I need them they pull this. I recommend everyone look thru the fine print in your insurance and read what is not covered. You might find that you will be left hanging in the wind after an accident with no coverage.

One of the elements of "hit and run" in many jurisdictions is knowledge of the at fault driver of the accident. This driver may very well not of been aware of it.

To me, this comes under your comprehensive coverage, the same as if a tree branch fell on you.

Get yourself a good personal injury lawyer and demand compensation. As trmn8r correctly pointed out this comes under your comprehensive coverage. Don't let these toads get away with this.

Get an attorney. This seems like a factual issue along a scale of events: At one extreme, if a board is lying in the road and a motorcycle runs over it-no auto coverage; at the other extreme a board sticking over the side of a truck hits a motocyclist as he passes by -auto coverage. In between the issues would seem to be "did the momentum of the truck give force to the board, that it would not otherwise have had, i.e. a board falling off and bouncing at 60 miles has more force, than a board dropped straight down." If so, then there should be coverage because the truck provided force which injured the op or made those injuries worse. Also, many auto policies provide coverage for the loading and unloading of vehicles. This could be construed to be an injury resulting from the "unloading" of the truck, although in an unusual manner. That is why a lawyer is important.

This is real easy. It is not covered. Do you just assume because you were riding your motorcycle that the policy should just pay? What if a plane had hit you? First thing I always tell people is to read your policy so you know what is covered and what is not covered.
