Capital One - Sneaky

CONNECTICUT -- We had hardship in our family and after paying ontime for 5 years we had to stop for 8 months so that we could catch up on our mortgage. We started paying again and after 3 months they took us to court.

We agreed to pay a certain amount every month. This was the set judgment (agreement) 1 month later we get a letter saying they put a lien on our house until all the payments are made.

Not sure how they got away with this. We went in front of a judge and thought it clear, we had to make a certain payment every month.

Real sneaky!!!!!

Exactly what were the details of your settlement? If such as thing was not listed as a possibility, you should probably have your lawyer take a look at what's going on?

A lien can result after a court proceeding, depending on what state you are in and what the court action/decision was.

You may consider this sneaky, but if it is legal it is simply a method of giving the bank some confidence the money that you owe them will actually be repaid to them.

You need a lawyer to determine if Cap One did something wrong. Sneaky isn't necessarily illegal, but it may be.
