LOS ANGELES, CALIFORNIA -- We live in Los Angeles, my wife had a not at fault accident but the other party was lying and claiming it was her fault. They gave us a representative who is trying to convince us that "maybe it was my wife's fault" UNBELIVABLE! they believe the other party before they believe our story, they refuse to give us our deductible back and juggling us around for 3 month and now they say that it probobly was our fault and that our rates will go up! I'm relly loosing it with this people and I got 3 cars insured with them. What a joke of a company, DONT DEAL WITH PROGRESSIVE.

Who originally said the accident was not the fault of your wife? The police or your wife? No one thinks an accident is their fault. Is Progressive your insurance or the other party's insurance company? Many times the fault lies with both parties and is not 100% the fault of one person.

How did the accident happen? You did not mention that. If the insurance determined that your wife was at fault then she was at fault. Do you think that insurance companies like paying out for other non-insured (by them) people?

Maybe if we had more information about what happened then we can make a decision on whether or not the insurance company was in the wrong. All we have is the fact that your wife says it wasn't her fault.

Without facts it is hard to tell. I would suspect that the damage to the vehicles and/or other witnesses support the other person more than your wife. For example:

If a person turns left in front of you:
If you hit them in the right front fender of their vehicle - its their fault.
If you hit them in their passenger door - probably still their fault.
If you hit them in their right rear quarter panel near the back bumper - probably your fault, because you had plenty of time to see them and did not slow down or take evasive action.

That's how the physical facts can make it mostly your fault, even though you do not think so.
