Paragon Services - Refuses refund after failing to provide the promised service.

ARROYO GRANDE, CALIFORNIA -- The term "Customer Service" should not be used in the same sentence with Virgin Mobile, it is non existent. I bought two phones, activated one, my wife decided to wait until I tried mine, I could not make a phone call. In the middle of my yard I could not get a single bar. I tried it at work, downtown, not a single bar. After over a week of daily trips to Radio shack it was determined that their service did not work in this area. Although they said it should. I had to re-activate my old phone with Verizon just to be able to call Virgin and cancel. They refunded the phones when they were received. However, their representative promised me a full refund on the $50 prepaid because I was unable to use it at all and for all the hassles and frustrations involved. After 10 days and no refund appearing, I called again. This time I was told that the erp had not processed the refund as promised, and now that the account was cancelled they could not process the refund. Basically he said tough! I am not dropping this, if I have to I will file small claims and force them to have someone appear!

By "erp" I assume you mean "rep". Was the transaction with Radio Shack or with Verizon? This is important as to not confuse the transaction.

In either case, I would hope some documentation was provided as to this promise to refund. If such a promise was not documented, I would consider it non-existent.

Claiming to file in small claims court is easy enough to state. It'll cost you twice the value of the card to file and have the party(ies) served. You may or may not get these fees back within a judgement, if you are able to get such a judgement.
