24 Hour Fitness - Failure to Properly Handle Injury Claim.

SANTA CLARITA, CALIFORNIA -- July 2011 Defective exercise machine casued damage to my right hand. After filling out accident report I never heard from 24 Hour Fitness management. It took me 3 months to finally get a phone number where someone would listen. Almost 2 years of back and forth, faxing documents. It was always to what I believed to be their insurance company but Insurance commission informed me that 24 hour is self insured.

I finally went to small claims court in November 2012 and won my case before a judge. Was it over? No sir. As usual never heard from them and finally with some persistence I was contacted by someone who said they needed a release but she would be gone for a week. 24 Hour Fitness has one policy "don't pay anyone even if they win". Their treatment of me is just one of thousands of the same type of cases. Their Risk Management is a joke.

If you have a judgement from small claims court, that they are being hesitant about satisfying, you may want to return to court and request a real esate or bank levy on the company. The court will issue the levy and you will need to pay a fee to the sheriff to serve the paperwork and collect on your debt. If it is a bank levy they will serve the bank and your judgement will be paid from any money currently in the company's account. If you serve a real estate levy on their property they will likely pay as quickly as they can gather the money.

The procedure is similar in most states and normally the court clerk can provide you basic guidance on the paperwork needed.

I am not in the legal profession, so any recommendations I make here are solely that of a layman.

Contact an attorney for a consultation. Then an attorney in your state can explain what rights you have to enforce your judgment. If you are allowed to in your state, get the sheriff's office to go out and start seizing their exercise equipment. That will make them respond.

Also, you do not need to sign a release. This is not a settlement. You won and have a judgment. When they pay you, then they can file a satisfaction of judgment.

Also, report them to the credit bureaus. You have an unpaid judgment, which they will not pay. Certainly a reasonable basis to report them.
