Burger King - False Advertisement

STOCKTON, CALIFORNIA -- On 02/28/2013 at approx 09:30 I went to the Burger King located in Stockton, Ca off of Arch Rd and went through the drive through and ordered two orders of the value chicken nuggets that are on the value menu advertised at $1.00 along with two value bacon burgers that are also advertised at $1.00 so when I got to the window to pay for my meal the clerk gave me a total of almost $6 and when I questioned my total I was told that those value prices were no longer valid and somebody must have forgot to change the menu.

I replied, "ok, well that's not my fault the items are advertised for that price so I'd like to pay that price so can I please speak to a manager?" and the girl at the window laughed at me and told the other girl baging the orders that I was complaining over a "couple of bucks" and wanted to speak to a manager and they both laughed, so the manager came to the window and proceeded to tell me that the prices are programmed into the computers and there's nothing she can do to overide the price and that they must have forgot to change the signs on the outside but the value prices have changed.

So I said, "So you guys are just falsely advertising prices then, right? Can I just have your name so I can follow up with a complaint because this is unheard of. All I'm asking for is to pay the price that you have the items listed for and she told me her name was Kanew, so I left without any food very dissatisfied.

Bad customer service and bad management. They should of just given you the food as a freebie for the false advertising.

Look at the California Consumer Affairs website. and you will see what the law says:

"County Weights and Measures (Weights and Measures (County) has jurisdiction over all pricing and scanner issues.

If anyone gets overcharged, they need to notify the store that there is a problem, and then notify their local Weights & Measures office.

Prices: Overcharges - AB 1721 (Koretz, D-West Hollywood)

Prohibits any person or store from charging an amount greater than the lowest price posted for a product, even if there is an expiration date posted for that product. This law clarifies that expired sale signs that are not removed must be honored by the merchant. It also clarifies the language of the law to cover scanner overcharges.

SEC. 2. Section 12024.2 of the Business and Professions Code is amended to read:

12024.2. (a) It is unlawful for any person, at the time of sale of a commodity, to do any of the following:


(1) Charge an amount greater than the price, or to compute an amount greater than a true extension of a price per unit, that is then advertised, posted, marked, displayed, or quoted for that commodity.

(2) Charge an amount greater than the lowest price posted on the commodity itself or on a shelf tag that corresponds to the commodity, notwithstanding any limitation of the time period for which the posted price is in effect.

(b) A violation of this section is a misdemeanor punishable by a fine of not less than twenty-five dollars ($25) nor more than one thousand dollars ($1,000), by imprisonment in the county jail for a period not exceeding one year, or by both, if the violation is willful or grossly negligent, or when the overcharge is more than one dollar ($1).

(c) A violation of this section is an infraction punishable by a fine of not more than one hundred dollars ($100) when the overcharge is one dollar ($1) or less.

Consumers can find regulations for item pricing in Civil Code Section 7100."

You have remedies. First, I would drive by today and see if the sign is the same, take a photograph of it WITH A CAMERA, then purchase the exact products saying nothing, so you have a receipt showing the overcharging. I would have the multiple copies of the photographs printed and multiple copies of the receipt made.

Then I would contact the county weights and measure and file a complaint. Ask them about the criminal statute. If weights and measures say it is a crime, contact the local police department and file a criminal complaint against the store. Good luck.

I would follow JR's advice and get proof, if you don't already have it.

The attitude that the CSR's had was completely inappropriate, but sadly not surprising considering the mentality too many of our youth have today. It isn't the $2, it is the principle.

As the reply above says, they should have just given you the food for free at that point. Of course, they should also send someone out to change the board immediately, which it doesn't sound like these bozos would even think of.

I had same problem with bk recently. I didnt argue i just took off lol. Promotions end at any time....so i went to McDonald's.

And they want to make it a law that these yo-yo's have to be paid at least 9 dollars an hour. By the way, that's the reason for the increased price, by golly.

three different BK locations-the bacon burger was One piece of bacon broken into three pieces, not
three full pieces as shown on TV. Complained at all 3 plus the burgers were not hot. Each place said I was the first one to ever complain. Well
rehearsed? = Strike 3-after 20 years my last burger there was two months ago, So Long.
