Auto Gallery - Lying and Intimidation Tactics at Used Car Dealer
Sales Dept. & GM of Sales - Complaint
GAINESVILLE, GEORGIA -- **UPDATE** So, the Auto Gallery saga continues in Gainesville, GA. The General Manager of Sales contacted my friend earlier in the week and said that they wanted to take care of the situation. He told her we would have the brakes fixed and give her a loaner car while they had her car in the shop. They scheduled a time for Saturday, 5/4/2013 at 9:00am. Sergio, the GM of Sales told her to only deal with him from that point forward, so she agreed. When she arrived today for her 9:00am appointment with Sergio, it was a game of intimidation and denial. He backed out of his verbal agreement to make the repairs, backed out of his verbal agreement to give her a loaner car, and tried to intimidate her into having these reviews removed from the internet. He tried to tell her they were slander. The problem with that is, slander has to be FALSE accusations.
Slander n. oral defamation, in which someone tells one or more persons an untruth about another which untruth will harm the reputation of the person defamed. Slander is a civil wrong (tort) and can be the basis for a lawsuit. Damages (payoff for worth) for slander may be limited to actual (special) damages unless there is malicious intent, since such damages are usually difficult to specify and harder to prove. Some statements such as an untrue accusation of having committed a crime, having a loathsome disease, or being unable to perform one's occupation are treated as slander per se since the harm and malice are obvious, and therefore usually result in general and even punitive damage recovery by the person harmed. Words spoken over the air on television or radio are treated as libel (written defamation) and not slander on the theory that broadcasting reaches a large audience as much if not more than printed publications.
This is all very simple for them correct. Stand by your word, of their salesman Luis, and now the GM of Sales, Sergio. What a great reputation you are presenting to the customers that you serve. You should all be ashamed of your unprofessional behavior. As I stated in previous posts, all you have to do is do the right thing and take care of this problem AS YOU AGREED TO! Then I will be glad to report the proper update. Until then, I will continue to make sure anyone I can is aware of your shady business practices.
I saw an investigative report on the local news the other day…seems like there are laws in Georgia about Dealer Fees and the like being added to the price of the car after the fact. Maybe I need to look into that a little more…
