BellSouth Communications Complaint - BellSouth unreasonable billing

Complaint
Review by goldduo on 2006-12-21
As a consumer from your state, I felt it was my responsibility to bring to your attention the following incident.

Dear Sir/Madam,

I would like to report an unreasonable charge by BellSouth which I think I am not supposed to be charged.

I signed a 3-year contract with BellSouth for phone and internet service for my small business (White Light Capital Funding, LLC) over a year ago. After one year, I decided that I have to move into a larger warehouse. I then found a place about 25 miles away from my old office/warehouse.

After talking to numerous people, I found out that BellSouth does not offer service at my new location. I therefore had to go with a different company (windstream/Altel). BellSouth drew $544.38 from my business checking account for 'termination charge.'

I have talked BellSouth representatives. They all insisted that I owe them the money.

I totally agreed that if I 'choose' not to use BellSouth at the new location, I would owe them the fee. However in this particular situation, I HAVE NO CHOICE: BellSouth simply does not offer services at my new location!

I believe that it is not my decision/choice to bleach the contract. So I should not be charged the contract termination fee.

I need your help to get my money back.

I appreciate your time.

As a resolution, I would like the following:

I would like to get my money back.

Please contact me if you need more details regarding this incident.

As distasteful as it is I don't think you will get your money back. If the contract has an early termination fee and there is no provision for moving out of thier service area, you are pretty much out of luck. From a legal standpoint you did breach the contract.

It sounds like regardless of your reason for leaving, you are still bound by the contract. Next time, see if there are any shorter contracts.
