TranSouth Finance Complaint - Threat made by a creditor

Complaint
Review by dgoodwin@equiserve.com on 2002-02-20
BEDFORD, TEXAS -- As a honest consumer from your state, I felt it was my responsibility to bring to your attention the following incident.

I spoke to a rep to have my January payment deferred, and pay my Dec payment. I had sent a physical check as well, and the rep told me to just place a stop on the check. They told me I was all set. I then got a call 2 weeks later telling me I was late on my payment. I called them back, and the rep told me that the first rep must have not put through the paperwork for the defferal, but that I was all set again. This morning I received another call telling me that I was 30 days late now on my January payment. I called to find out why. They directed to call the manager that denied my request (Christy Hoffman). She explained that because my check came back with a stop payment, that they could not approve my request. I tried to explain that a rep had instructed me to put a stop on that check. I then explained that I had just sent my February payment by check, which was met by her asking 'why I keep sending checks.' I thought this was how I should pay (as I always have). She also said 'common sense' should have told me to call to find out if my deferral was approved. I said the rep told me I was all set, so I assumed I was 'all set.' She then told me that we all know what people say happens when we 'assume.' She then told me to drop my attitude (I admit I was upset, but I wasn't giving her atitude), and that it was early there, and I shouldn't get on her bad side (which was a threat). She also said that if my Feb payment was received within 5 days, she would defer my January payment. I tried to ask if the rep should have told me to call back to see if the deferral went through (since they made it sound like it already had), but she would not let me speak. She became very irate, refused to let me speak to her boss (because my account was not up to date, due to the misinformation from her reps). She became even more irate, and said I was denied for the deferral (because she was mad). I was insulted numerous times, and threatened by her. I have more to say, but it's too long to keep going.

As a resolution, I would like the following:

I do not want to have to deal with this company again. She is in a position to ruin my credit (it's already bad enough), and who knows what else she is capable of with all my personal info. I would like for them to either take the truck, and do with it as they like, or to eat the remainder of my payments (which I know won't happen, so option 1 is preferrable).

Please feel free to contact me if you would like more details regarding this incident.

"and that it was early there, and I shouldn't get on her bad side (which was a threat)" Not by any laws I know of. If you want action, especially to an Attorney Generals office, you will need to be much more specific with what those threats were. I would assume the creditors name did accompany this letter somewhere, as that would help too.
