BAD BILLING CLASS ACTION LAW SUITE - Complaint

KANSAS CITY, MISSOURI -- I had the horrible and on going expercience with gold's gym as it seems a lot of people have. I am trying to find out how many people have been over billed/charged by gold's. I am also trying to find some information out from the attorney general about starting a class action lawsuit against their terrbile billing practices and misleading sales of their contract. If you have been through this or know someone who has please have them read this and respond to it so we can get a good idea of the number of people this has effected. I also have the email address of the internation golds gym represenitive who is in charge of over seeing that the franchise owners are operating under their guidlines, so if you would like to write him his email is bpeek@goldsgym.com Let him know how horrible some of the franchises are.

I wouldn't waste your time trying to start a class-action. The only winners in those drawn-out battles are the lawyers. Good idea on contacting the franchise rep though! I'm sure others will appreciate that bit of advice...

I am so glad I'm not the only person going through this. If you read my comments it explains pretty much what is going on with me. Since Killeen Tx is a military town, I believe they are taking advantage of our soldiers especially the families. Now you know I am one of them and who knows how many more are out there. I already put a complaint into the BBB and the attorney generals office and hopefully to get my original contract and go and talk to Jag about this.

I disagree with the post that states only the lawyers get anything out of class action suits. I was recently a part of a 24 Hour Fitness class action lawsuit where we were awarded $58 million. Each person received no less then $25,000. So it can be worth it.

I am in the same boat. I was a member for 4 years decided to freeze my membership signed a contract to freeze. Later they still continued to take the same amt of money out of my checking account went back in to talk to them and found that they had changed the contract that I had signed and agreed on to something totally different and yes I do have the copy of the original one that I signed and agreed on. Then after this happened I spoke with the manager and told him that after this fraudulent thing that they did I wanted to cancel my membership he said that would be fine and he would give my money back from me that they took out after I froze my acct. He said everything would be taken care of. I went back in and had to fill out another contract to cancel membership and it was written on there what Roy said (manager). Still after this they continued to take money out of my acct and still had me as an active member. I had to contact my bank and they stopped it everytime they tried because they were no longer authorized to do so. I attempted to call and nobody would call me back, not even the main office. I did speak with the attorney generals office and come to find out they had several complaints of the same. I waited to send everything to the Attorney Generals office because I wanted to see if they would finally take care of it. Now, today I received a letter from their credit department stating that I owe 52.10 I called and they said it was because I cancelled my membership. I had been a member for approx. 4 years, there should not be a charge for cancellation. When I called to discuss they laughed at me and would not talk to me about it and also the manager "Roy" would not talk to me either. He said that if I contact a lawyer then he will do the same and he left it at that. This is nothing but fraud and I feel that something should be done I have been fighting this since May of 07.

My name is Troy L. Miller, and my partner and I signed a contract before reading the small print, as it is we have signed a contract for 2 years. The cancelation policy was not explained. Also I listed my mother as an emergency contact, and this individual was trying to save his behind. For a guy I have a high pitched voice, so he called my mother, saying that she called and made statements when she did not, then I was accused of posing as my mother. The owner stated that I was pathetic, and and his representive said that that they will get my money one way or another. I have cancelled my card with the bank. I still have to pay cause of the signed contract, but I am not going to participate in the Gym, they are liars and are crooks. They also made my mother very mad.

I recently joined Gold's in July. I tried to cancel my tanning in September, their emails were so generic I assumed inquiry closed meant it was done. I went to pay and they wanted me to pay for the tanning. The rep was actually nice and told me I was being charged for lockers which I was told were free as part of a deal! The gentleman who signed us up got fired for lying to members. How lovely. Well they were kind and told me I only had to pay for the memberships for $53.24 each. One for myself and one for my fiance. I also set up auto withdrawal, the form says monthly dues, $53.24. Has my signature and cc #. They took out $47.68 and $30.65, for late fees on the tanning and locker fees. The location employees have been very nice, but their corporate office won't reply! They caused my account to overdraw 3 times!!! $102 in fees! I am furious!

I have had a horrible experience with gold's gym. I am out $1500.00 because of this money hungery company. I signed a two year contract in 2002. I stoped using the account they used to charge my monthly payment of $27.57. My bank called and informed me that for the past 3 years gold's has been charging that account every month! I called and they said I never cancelled two year contract. I remember when my contract ended in 2004 they kept charging my account so I called them several times to try to get them to stop and they said they would take care of it. Assuming they did, I moved on with my life(not using or checking that account anymore.) The account was still open, but I never checked it because it wasn't being used. I talked to gold's gym about getting my money back that they had been stealing from me all this time. they said I signed a contract that automatically renewed my membership. I then threatened with a lawyer and the lady barbara that I talked to said, "you can do what you want, we don't care!" I am shocked that they can get away with doing this and it has got to be illegal. I know of several people that this has happened to as well.

I was glad to see someone inquiring about this. I would love to be a part of a suit against this corrupt company. Gold's in Modesto, CA has refused to cancel a membership after the contract date, due to due disputes. Now they've taken advantage of the self-licking lollipop of billing cyles and circular cancellation authority between the franchise and the financial institution to extract even more money and late fees out of us. Somehow the amount I owed went up by twice the monthly dues in a two week period. I am compiling the full story to send to the BBB and possibly to an attorney. Someone needs to stop them!

Wow, I am shocked to see that there are so many problems with GG. This is NOT impressive. I am going throught the exact same damn thing!! I am in debt with them about 1,000.00 (500/account) And I wanted to cancel because I have moved 25 miles from where I was going. And they wanted proof of my utility bill, lease (rent) or Settlement paper (house ownership) and I was like, that is a little TOO PERSONAL! But okay, block out my account number from my gas bill. I have been getting harrassement calls directly to my VP [Video Phone] Sorenson Video Relay (It's for the deaf/hard of hearing individuals using an interpreter as sign language to commnicate) saying they REFUSED to close the account and said I must pay every month until the 2 year contract is paid. Or to pay the full 500 each account and it will stop. They have charged me return fees for a credit card that was maxed out and determined it was "lost". I have told these idiots, "Theres a difference between lost cards and maxed out cards" and they waived it but still seems to be charging. I recently heard that 24 Hr fitness got sued. There IS a law for fitness providers to follow and must do it. If I can find the letter from 24 Hr Fitness lawsuit, I can write up what it says. The person that has filed a lawsuit is: Daniel Friedman. This is what was written: (prior of the lawsuit) Plaintiffs filed a class action lawsuit against 24 Hour Fitness regarding its practice of charging monthly membership dues after 24 Hour Fitness recorded a request to cancel or terminate the corresponding club membership. According to Plaintiffs, the disputed charges were made using electronic fund transfers (“EFTs”), whereby 24 Hour Fitness automatically withdrew funds from a Settlement Class Member’s bank or credit/debit/charge card account after 24 Hour recorded a request to cancel or terminate the corresponding monthly membership. According to Plaintiffs, 24 Hour Fitness took this money by fraudulently representing to its payment processors (entities that process electronic payments on behalf of 24 Hour Fitness) that it had authorization to withdraw these membership dues from Settlement Class Members’ bank or credit/debit/charge card accounts. Plaintiffs allege that this practice violated the Racketeer Influenced and Corrupt Organizations Act (“RICO”), the Electronic Fund Transfer Act (“EFTA”) and state consumer protection laws.

I don't know if anything ever came of this but I would like to be a part if anything ever did. I am being charred for a 6 month personal training contract that never existed and I can prove it with the unsigned and forged paperwork provided to me by Gold's Gym Kennesaw.

I no long am a member at Golds Gym. But had a issue with billing of child care. They billed me for over 6 months sometimes even different amounts. They didn't reimburse me the full amount either.
