MotoBahn USA Complaint - Going out of Business?

Review by dancin on 2007-02-05
PENNSYLVANIA -- I placed an order with this company on January 12, 2007. I have not received the order as on today February 5, 2007. Their website states that the order was shipped, but no tracking information is available. They do not respond to emails or telephone calls. I believe they are taking orders with no intention of sending the merchandise. They charged the order against my credit card. I believe they may be going belly up but trying to get as much money as they can before they file bankruptcy. I would not purchase from this company under any circumstances.

If you are confident you won't receive your merchandise, file a dispute with your credit card issuer on the basis that you did not receive your item(s). They must immediately credit your account until the dispute is resolved, either upon receipt of merchandise or refund from company.

I agree with all of the above. File a dispute with your credit card, then the dispute department will take it up with them, this way you won't be out of any money. Do it now, don't wait.

The Saga continues....

I called my bank and they credited my account for the total amount. A couple days after that, I got an email from Michael Fusco (mike@motobahnusa.com) at Motobahn USA. He apologized for everything. He said the jacket was suppose to have been shipped by the manufacturer and the manufacturer never notified Motobahn about it being on backorder. In addition he said his company had moved to a new location during January and thats why the phones were screwed up. So he said that I could pick any jacket I wanted from their catalog and no matter what the cost he would send it to me. Then he gave me his direct phone line (267 614-3003) to avoid voicemail. But if I got his personal voicemail I was to leave a message and he would call right back. I responded to the E-mail address with a message and then called his "direct" line and got his "personal" voicemail, so I left a message there also. This happen on Friday the 9th and guess what? No reply to either the email or the phone call. Can you say "Flake"...I knew you could.

I just found out I can file a claim/complaint online with the Federal Trade Commission and the Federal Communications Commission...I guess they are starting to get pretty hot with online fraud. So I will file those tonight.

Caught me too. It's strange because they are on so many bike related sites too. I registered my complaint today eith the FTC, called my bank to dispute the charge (they agreed due to the "3 to 7 day shipment" statement they have on their sits), notified the BBB and am waiting for a call back from the Doylestown, PA Police Dept. Thought I would file a formal complaint for fraud. What the heck, I don't have the jacket and he took the money... If I get a response I will let you all know and maybe we can get this guy shut down.

I wish I would have found this site before I purchased anything from MotoBahn as I too was ripped off much the same as everyone else, and I too thought because they advertised on so many sites they could be trusted, obviously not!!!!!I was advised by my bank to file an affidavit and a police report, so its in the works. If I hear anything from Motobahn, and we all know its a big IF I'll let everybody know.
