IGIA - Windstorm Complaint - Windstorm Vacuum

Review by DOC4321 on 2007-02-22
When we ordered our vacuum we were told the money would be taken in stages divided over four months, instead they took it all at once and the very next day they took another 130.00 That had nothing to do with them.Upon arrival we sent them right back for a refund. That was it. We were taken for 300.00 And we don,t even have the vacuum to show for it.One other thing we learned from all of this is the fact that the new york state consumer protection agency, federal trade commision and attorney generals office are #@%&$# worthless.

Questions:
1. What was the purchase price supposed to be?
2. Do you have the payment plan documentation?
3. Did you give them access to your checking account?
4. Did you get a receipt for the return?
5. How long has it been?
These are key issues as to what you can do.
The agencies you indicate compile complaints. They do not intervene on an individual basis.

Sounds like you have the necessary documentation. Now file a small claims case against them. You can collect ALL the money they have cost you. That includes the filing fees, shipping costs, bank penalties (if any), and postage. It will help tremendously if you have a couple of letters requesting resolution from them showing your good faith. I hope this helps you. Good luck.

Yes, you file in the county you reside in. Actual procedures may vary from place to place. Your county clerk should be able to point you in the right direction.

You can pay for serving the summons thru the sheriff's department. You can also recover that cost also so be sure to include ALL of your costs when you file.

You are going to have to invest some time here finding names, addresses, etc. but it CAN be done.

No guarantee here, but in all likelihood IGIA will offer you a settlement shortly after they are served with the summons.
