The Richmark Group Complaint - Suspicious Copyright Claims

Review by Fortunate1 on 2007-05-15
CHICAGO, ILLINOIS -- I don't know where to start with this issue, so I'll just ask if anyone has had any experience working with a market research company called The Richmark Group based in Chicago, IL.

I hired them to do custom research studies. These are studies where I developed the research objectives and specifications and where I managed the overall output of the results. They weren't off-the-shelf studies that the Richmark Group had done on their own.

My problem is, now that I've paid them to do this work, they claim to own a copyright on the research and they're trying to dictate how and when I can use and present the results of my research.

Does anyone have any experience with this type of issue or any experience with the Richmark Group? Again, they perform "work for hire" and then claim to own a copyright on material for which they have been paid.

Thanks for your thoughts!

I guess it all depends on what you signed up for. Did they offer a statement of work, a contract, a proposal? If it wasn't spelled out in advance that they retained copyrights, then it might be time to have your attorney write them a letter. Best of luck.

What does your contract with them state? If it is in the contract they could very well retain ownership and control of what you paid for. EDUCATION is what you get when you read the fine print. EXPERIENCE is what you get when you don't.

Hm-m-m. That's the kind of work I'm in. Maybe I should rewrite my contracts and put it in teeny tiny print. I'd say Richmark has a good deal going for them. Don't think that would be something I'd feel comfortable doing. When I finish a project, I turn everything over to the client.

Reread that contract very carefully.
