Dell Computer Corporation Complaint - Harassment - Dell Financial
In March 2007 I received a call from Dell Financial Services. When I answered the telephone, I was immediately asked for my current address, which I provided. I then inquired about the subject of the call and was informed that my husband allegedly had a past-due account for our alleged purchase of a Dell Computer system.
I informed the caller that we had never purchased a Dell Computer and had no such account. The caller then provided my husband's name, birthdate and social security number. I asked how they got our telephone number and was told that our former number (we used to live in California but had moved to another state when we retired) had a forwarding number to the current number, which was a lie. We did not request that the phone company provide a forwarding telephone number, we simply closed the account and had the phone disconnected.
I was told by Dell Financial that we had to go to our local police department and file fraud charges about the account because someone had provided my husband's information.
On my own I was able to determine that our 35 year old son, named after his father, had an account with Dell Financial and had purchased a computer sytem. He provided me with a copy of his on-line application, which clearly reflected his name, his address, his birthdate, his social security number. He admitted that he was about a week late on his payment and that he'd get the payment in right away. He also said he would call Dell Financial himself and try to straighten out the account problem.
I received another nasty call from Dell Financial about a week later, claiming that they had not received payment and that the nonpayment would be detrimental to our credit rating. At that time I provided all of the information for our son, phone number, date of birth, social security number, etc. I was told that we were still responsible for the account because they had our information. I demanded to be transferred to Dell's Legal Department or to be provided with the name and phone number of their legal representative. They refused to provide same, saying they did not have any legal representation.
Thereafter, I sent a certified letter to Dell Financial, providing copies of the application and Dell's written confirmation, all with our son's information, not ours. I reiterated our son's current address and telephone number. I demanded That they immediately cease contacting us and that they remove any and all negative reporting to all three credit reporting agencies regarding my husband's social security number.
Since then, I have received at least 15 more calls from Dell Financial's various collection agencies, all extremely rude, all threatening, and each one refusing to acknowledge that the account was opened by our son and was not our account. Each time I spoke with them, they claimed to have no knowledge of our son or his information, which I had no provided numerous times.
I have asked for written proof that there was an application made in my husband's name, with his birthdate, social security number, telephone number, etc. They refuse to provide same.
In the meantime, our son has sent his regular payments, none of which have been cashed, allegedly because the account has been placed "on hold" because of an alleged fraud.
Dell Financial Services has never contacted my son for payment. My son finally spoke with the "account supervisor" and told him that he would pay off the entire balance at the end of the week. Since then, they have continued to call our home every day. I have not answered nor returned their calls in a week. Today, a Saturday, I received three calls, all unanswered.
I would really like to sue Dell Financial Services and its various collection agencies for harassment and illegally obtaining and using my husband's social security number and other personal information, among other legal complaints. Someone really needs to get a handle on this company!
For the record, I would NEVER purchase anything from Dell Computer because of this experience, and I will tell everyone I know about how my husband and I have been treated!
