State Auto Insurance Companies Complaint - State Auto insurance scams

Complaint
Review by VKaranovic on 2002-06-15
LOUISVILLE, KENTUCKY -- As a honest consumer from your state, I felt it was my responsibility to bring to your attention the following incident.

Dear Sir or Madam,
Each time we received State Auto Insurance ads in our mailbox we're remeinded of the time we were ignored, abandoned, by this company. My personal nightmare with State Auto began when the woman that hit me was sighted for the accident. The police report stated that the other driver was a 100% at fault. My insurance blamed me for fault of the accident, based on their findings!?? My insurance has gone up $400 per 6 months, and this will be on our record for the next 5 years, because State Auto did not do their job.At S.A. you will be paying for benefits and coverage you'll never receive.Altough we as a policy holders had paid for auto coverage and acident-related benefits,State Auto makes every attemp to delay and deny those benefits covered under NO FAULT! They have forced us to pay $500 deductible even to start repair our car.The body shop declared the damage estimate far too overpriced. The car had been in the shop over two months.During the course of this adventure they've promised us $500 deductible back and rent-a-car reimbursment after lawsuit is over. They told us we have to wait at least 6 months for money refund. We are out an $800 (deductible and rent-a-car cost)and I am being told that I have to give them all my personal information and being treated as if I did something wrong. When I called our agent and asked him why I was being treated this way she stated that it was normal for all settlements and that S.A did this on all claims. S.A. is targeting people who are completely desperate or completely oblivious to their tactics.Their six months was gone. I have asked for our $500 deductible and reimbursment for rent-a -car.We do not know even today why we have to pay $500 for being the victim in an accident. After insisting on the return of our money they've told us that our agent Cynthia Harrison is fired from job. Then we went to Lisa Blevins S.A. representative. They told us that Lisa is fired from job too.Very odd?Had I not paid my premiums or commited fraud I could understand this.

As a resolution, I would like the following:

Desired Settlement: Refund
Settlement Explanation:
We are asking only for our $500 deductible refund.
Their reimbursment for two months rent-a-car we do not expect because policy holder mean nothing to State Auto insurance Company. Their insurance contracts are pure fraud.

Please feel free to contact me if you would like more details regarding this incident.

First of all, if they told you they are going after the other company, and they will reimburse your $500.00 deductible, they did not mark you at fault for the accident. Legally, in order for them to seek 100% reimbursement from the other carrier, they must document that you were 0% at fault.

Secondly, the deductible is part of your contract. You owe it any time your insurance company fixes your car regardless of fault. It is your responsibility to pay it no matter what. They paid the rest of the damages to your vehicle and are now seeking reimbursement for you, and state auto. This is a situation where you are both wanting reimbursement and the OTHER company is dragging their feet. This is in no way the fault of your insurance company. The deductible creates a situation where you both benefit from successful subrogation of the other party. It is there to ensure your cooperation (if needed) in their efforts to gain reimbursement. It is unreasonable for you to expect a refund for the deductible which you are contractually obligated to pay. If they get their money back, so will you. If not, you both can write it off as a loss. They fixed your car, and you didn't have to pay the full price of the damages, be happy for that. You chose your deductible when you started the policy, you can change it at anytime if you don't like it.
