DirecTV Inc Informative - Contract Termination Fees
SPRINGFIELD, MISSOURI -- My name is Gwyn Pavon. My husband and I started service with DirecTVin December of 2006. We loved our Direct TV. The programming was great and we loved having DVR Service. Recently my husband and I bought our first home. This was definitely something to celebrate.
When we moved we called and scheduled our move. On moving day the Direct TV service guy showed up to install our Direct TV. Unfortunately, they could not find a line of site for the satellite. So I called the service department and they set up for another service guy to come and for a second opinion and offered to pay $100.00 towards any custom work that would need to be done in order for us to be able to have service. I was happy to know that it was still a possibility that we could have service. Again, the Direct TV service guy came to our house and again was unable to find service even with custom work. Our new house just happen to be in an old neighborhood with lots of old trees. My husband and I were very disappointed to find this out. We were not going to be able to find the same programming with cable.
Because we were unable to find a line of site I had to cancel our service. I didn’t cancel because I wanted to. I cancelled because I had to. We had a fairly new contract with DirecTV and new there were possible penalties but I had no idea what was in store for us. I spoke to the service rep to cancel on Wednesday, May 13, 2007. The service rep I spoke to said that I could write a letter to the billing department and ask that our fee for breaking our contract be waived due to our circumstances. She informed me that we would have to return our receiver and she would be sending us a box to return it in. We received that box on Wednesday May 20, 2007.
She said we would receive a statement in the mail showing what charges would be due and if DirecTV would waive the fee. On Thursday May 21, 2007 I received a charge from DirecTV for the amount of $262.85 on my checking account. I was in shock! I had not even received a statement showing the amount owed or what the charges were for. I wasn’t even given the chance to pay my bill. I was not set up for automatic billing and I had not called nor did I go on line to make a payment. The only time I gave my debit card number and authorized a charge was when I set up service in December and that was a one time authorization. I was blind sided. Because I had no way to prepare for this charge, no statement showing charges owed the charge resulted in a negative balance on my checking account. The negative balance incurred a total of $125.00 of overdraft fees.
I am very disappointed and devestated that DirecTV has the legal right to do this. Fortunately I work for an attorney who is taking care of this matter for me. We are asking for a refund. After all the stories I've read though I feeling pretty discourage that I will get a refund.
