Butta Inc. Complaint - Non-Payment of Graphic design Services

LOS ANGELES, CALIFORNIA -- I was asked by [name removed], president of Butta Inc., to design t-shirts, denim, apparel, and other related concepts for the Butta Inc. clothing line, and I was never paid for my services. I was sent a $750.00 check for (3)three of the 63+ designs that I was asked to do, from the Butta organization and It bounced. I was charged $15.00 for the bounced check, so after trying to contact and notify the Butta Inc. organization and [name removed] for payment, I have not heard from Butta Inc, or [name removed] since.

After being notified by a friend of mine in LA, who saw some of my trademarked, and copy written designs that I'd previously shown to [name removed], of Butta Inc. in his Crenshaw Baldwin store window, I tried to contact [name removed], and or the screen-printer who printed these unauthorized designs to find out how many garments that were counterfeited, so that I could tabulate what I should be paid.

I was shocked to be asked by the screen-printer for a $1400.00 one year overdue payment that Butta Inc. has owed them after soliciting them to print these federally trademarked and copy written designs!

I've also found out that [name removed], of Butta Inc,
has used other screen-printers to manufacture and produce my federally trademarked and copy written designs that were not authorized by me.

After telling them that I was only the graphic designer that Butta Inc. also hired, and that I have nothing to do with their payments. I also explained that I'm also attempting to obtain overdue payment for 63+ designs @ $250.00 ea. that I've done for Butta Inc.

The Butta organization said that they will be doing a clothing deal with Macy's stores, so If you're ever accosted by [name removed] or the butta Inc. organization, please beware, and always ask for half up front, because Butta Inc. does not like to pay their bills.

I have pictures of my designs in his store, a copy of $750.00 bounced check, and a $1400.00 invoice from the screen-printer. I also have 63 designs that I was not paid for @ $250.00 each.

I also have a written statement(s) from another individuals that Butta Inc. and or [name removed] has taken advantage of.

Sounds like a pretty easy case, especially if you designs he was using were trademarked. I would call an attorney to go after your money. The case seems straightforward enough to file in small claims, but I think your monetary compensation is over the maximum amount allowed in small claims.

Thank you Chemman. I'm looking for an attorney that will take the case on a contingency basis, pro bono. I'm a freelance artist, and funds are limited right now.
