DELAWARE, OHIO -- Over the course of three years with National City bank I have received close to $11,000 in overdrafts. There have been many times when I was keeping track of my checking account online and noticed variations in my balance that were unexplainable. The outcome of which was of course multiple overdraft charges applied to my account. I have never been able to get the proof after I complained. I would just go into the bank expect them to find the error and correct it. However most of the time they would deny my claim and send me packing with charges still on my account and by the time I would get home to print it out it has always been changed.

Recently I was fortunate to catch it and print it out so i could take it in and confront them. Even with proof in hand they gave me some story of maybe my funds that I had deposited 10 business days before were not available yet. But they didn't know for sure and could not look it up. Or at least the manager at that branch couldn't.

This is not the first time they have charged me with some frivolous charges and probably will not be the last. I need help in getting my money back and I mean all of it. At this point I would say they would be hard pressed to get proof that all of the charges on my account were real and it has to stop. I know if it has happened to me it is happening to others too. After $11,000 in fees why are you still with that bank? Either you must have "money to burn" or are in bad need of accounting education.

$11,000 in OD's in the past three years? At $34 per overdraft, you're talking about, on average, over 300 per year for each of those years. You're not going to get any money back. You need to learn to keep better tabs on your accounts.

A Class Action or personal lawsuit will not help if you don't have 100% proof. I would call and/or write the Federal Banking Commission with anything you do have and they MIGHT audit the bank to try and find proof if there is any.

What the bank is doing to you in not an uncommon practice but what is uncommon is that you have let it go on this long. I would suggest you get what money you have left out of there YESTERDAY! Good luck to you.

I'm with Lidman on this one, if you don't have proof, you are not going to get any money back by filing a lawsuit.

Most banks have an internal research department that handles disputes. Have you contacted them yet? Their job is to research and provide you with the details, though I suspect that there is a statute of limitations and they probably won't go back 3 years.

What stands out for me from your post is that you say there have been many times you were keeping track of your account online. Online account information is not always up to date and 100% accurate, you should always, and I mean always, keep a register that you keep up to date daily.
