Orchard Bank Card DBA HSBC Complaint - Fraudlent Credit Protection Insurance or Service

GEORGIA -- I got a credit card from HSBC Orchard Bank after I had some bad credit problems trying to get re-established. They offered a Credit Protection Plan called Account Secure I opted for this service as it reportedly said it would protect you in the instances of illness, unemployment, divorce, hospitalization, even unpaid family leave of absence. I had the card for about a year and a half. In October of 2005 I became ill and the doctor put me off of work. I filed the papers for this protection and I went around and around with them about this benefit. Finally in March of 2006 they granted me the benefit. However in the mean time the bank started bring collection proceedings against me and had slapped late fees, overlimit fees and now legal fees. They have filed suit against me and even though I have a letter from the Account Secure division they are failing to acknowledge this and are proceeding with a law suit against me to seek full payment with legal fees. I feel that this is contary to our agreement and that they have frauded me in collecting a fee on my account for a service that they are failing to recognize. I am poor and to hire an attorney would cost more than to pay the account off. I have been reported to the credit bureau and have been charged late and overlimit fees and to surrender to this I feel is wrong but I am sort of defenseless. I think this company is wrong and is practicing unfair and even illegal collection practices and should be held to their agreement and accontable for selling me and perhaps others a false sense of protection. What Can a person do? I think this company is a rip off.

Get all of your documentation together to show you have paid for this insurance. Especially a document showing the insurance finally agreed to pay. Be sure to respond to any paperwork you get from the courts. File a written dispute to the credit bureaus including placing a statement in your file that you believe this issue is in error. Do this certified mail/return receipt.

When ordered to appear in court do not ignore it. They will get a default judgment if you do not show. Present your defense to the judge. If you can prove you had the insurance HSBC will most likely be ordered to reverse the charges and retract the negative information in your credit files.

Agree with tnchuck100.
Keep everything in case you have to appear in court.
They have no legal rights to collect late fees if they are the one that cause your CC bill to be late.

HSBC Stinks! Stay away from HSBC. I tried to open an account with them via HSBC.com, had issues with their complicated sign-up process that was full of BS by the way.. The customer service guy had a thick Indian accent and would not transfer me to someone else who spoke clear english. They stole my $1. sign-up balance for closing the account early.

I am so glad I did not give them a penny more. Do you think anyone, who doesn't speak english will get my money? No waaaaaayyyyyyyyy!!!!!!!!!!!!

I have noticed that some of the customer service centers are located in India and those people try to fake an american accent. Anytime i hear that fake voice, i hang up.

Orchard Bank is the worst company to deal with I had a secured card with them all they did was try to keep my credit score down and and used additional funds for 3 months before applying them to my secured card. Do not give these prople a penny.because you will never improve your credit with a rip off company
