Suncom Informative - Contract Complaint

Review by TickedoffCris on 2007-09-11
CHARLESTON, SOUTH CAROLINA -- I'm about to file an Arbitration against Suncom because its reps are just plain stupid, here's my story (as much as I can give w/o identifying myself to them):

In Suncom's terms and conditions, it plainly states that if they change their agreement and I (customer) disagree, I will have 20 days after receiving the new Terms and Conditions in the mail (never did) to cancel my contract without a cancellation fee. I totally disagree with the changes to new Terms and Conditions but I can't get anyone of their reps to understand what the Terms and conditions are!!! They think it only applies to new customers!

I've even spoken to a supervisor who told me that the "new" set of Terms and Conditions only applies to new customers, although the new Conditions states otherwise. Furthermore, there are two, yes 2 different terms and conditions posted on their website!!! And of course, neither one of them has the updated date listed on them and they're completely different. The only reason this supervisor knew of another contract was because I told him of it!

I could write a novel right now to fully explain my situation that I have went through with this company in the last couple of days. According to their Terms and Conditions, we are able to initiate an arbitration to resolve this dispute. I refuse to pay an early cancellation fee when it's written in their terms that I wouldn't be as long as I advise them I don't agree with the new Terms. I did that but the reps just don't understand (guess I can't expect them to).

If anyone wants to join me.... Please post soon.

TickedoffCris: Maybe you should send a letter, via certified mail, return receipt ,outlining your complaints. Maybe you will get some action.

Thanks FedUpAndPissed,

My letter is already in the making and I will have my attorney review it before I send it to them. I also found out that if I initiate an arbitration I must send a copy of it to the organization that I choose to handle the dispute. According to them, Suncom will have 10 days to reply to my letter.

I highly doubt that SunCom will want to spend the effort to challenge me because since I'm the one who will start the arbitration, I get to chose the place where the hearing will be held (if it goes that far). My only concern at this point is that they will not cancel my service because of this.

My only concern is that they WILL cancel my service because of this blog!

UPDATE:

Just to keep you guys posted, I filed my complaint with the BBB on the 18th. Tomorrow will make it a week that I haven't had any response. I think I will just give the BBB a call.

FYI: T-Mobile will be purchasing SunCom next April. Wonder what this will do for customers with unlimited minutes?
