Concerning: The bill from Dish Network
I received an advertisement through the mail for Dish Network It expired 6/31/06
I called to ask about it. I was told that the price was $19.99 a month and I had to agree to 18 months. I was told there would be no other charges during that time. I verified the price of $19.00 and ask if any other charges would be added at any time three times. She said No each time. She said the VCR was free, but was to return it after the 18 months was up. I would get the Starz Package for three months for free and I would not have to pay to have it removed after that time. She reassured me all I would have to pay was $19.99 a month for the duration of the contract. Then I agreed to take Dish Network I gave them my credit card number only until I received the first bill they said they would not run any charges on it. I agreed to pay by check. She told me she would hold the information until I sent them a check. They said they would never charge on the card. I never charged my monthly bills on the credit card. I always paid by check. They did not have permission to charge this bill.
3/22/06: The installer arrived and started the installation. He said we would get 120 channels I asked him to check the price as I had agreed to pay $19.99 a month. He checked his papers and told me the agreement on the phone would hold. Later, he asked where the phone jack was. We told him there was no jack in this room. The sales person never told me we had to have a jack. I would not have ordered the service then. He told me she should have, but I could buy one at Radio Shack for about $50.00(they are closer to $100.00) Or I could pay the phone company to put one in. If I did not have one plugged in, I would have to pay an extra $ 5.00 a month. We agreed to run a line across two rooms until we could figure this out. He connected the service in the living room and in the bedroom. He adjusted the remote controllers in both rooms. He showed us how to use the remote in the living room but because he was late for his next appointment, he left. Before he left, he gave me a copy of the installment agreement. Our copy did not have any prices on it. When we checked the bedroom TV, it did not work. I called and they said I would have to pay a service call to get it fixed. We only used the living room TV after that.
We received a bill. The bill stated we owed $65.97 for the first two months service. We started calling customer service that day. After nine calls(twice talking to persons that could not speak English and once being put on hold for over 24 minutes) I talked to someone who made arrangements with us.
One woman said she tapes all calls and if the salesperson gave me the wrong information she would have to fire that employee. I told her to check the tapes and train her people so this would not happen.. She never got back to me.
Another person told me Dish Network subcontracts their advertizing section out and Dsh Network is not responsible for any agreements. I have to go throuh the local subcontractor.
I finally spoke to someone who tried to help us. I told him I wanted to cancel the service. He said I would have to pay $240.00 to cancel the service. He explained that the first person did not explain it right, that agreed to 120 channels, three months at $19.99 and for the remaining 15 months at $34.99. He said we would have to pay an additional $ 5.99 for a service protection plan to get the remote in the bedroom fixed or pay another $60.00 to $70.00 for a new remote. He was very sorry that the first person gave us the wrong information. The best he could do for me was a downgrade. He could give us 60 channels and I would have to pay $ 19.99 + $5.00 for local channels and I could have this for 12 months. With this new agreement, we would have to have a new box. He told me to call 970-207-0425 and have them change over to a new box or I would have to pay another $ 5.00 for the box in the bedroom(the one that did not work). He said we were to ask for a “Standard Equipment Box with duel Turner” He then confirmed that I was on a cell phone and not the land line so the Tech Dept could get into my TV and make the change to 60 channels. I was put on hold for 35 minutes and then I was disconnected. Three phone calls later my service was changed to 60 channels. I then called 970-207-0425 and they set a date to exchange the box. They told me I would have to pay $50.00 for this service. I objected and after talking to one sales person, two managers, they agreed to do the exchange. A couple days later the exchange was made and a new contract was brought out. When I read the new contract, I refused to sign it. I had a verbal agreement for 12 months, 60 channels, no $5.99 for a service fee, no cancellation penalty and no one was to take the money from my credit card. He said he would stop by with a new agreement. He never returned. They billed us $5.99 extra for the remote for four months. Each month we had to call and they would remove that charge.
On 4/20/07 (after the twelve months was up) I called to cancel the service. They told me I would have to pay a about $240.00 to cancel at this time. She said " Didn't you read the fine print?" I told her we did not sign a contract. She said she would send us a copy of the contract. We have never received a copy. I asked for the last two days we had already paid for and she said, No, If I was cancelling, she had to do it now. We were disconnected 4/20/07.
I sent all their equiptment back.
They then sent me a bill ON 6/20/07 for $71.60. I sent the bill back with a note saying "WE PAID OUR LAST MONTH BILL WE RETURNED ALL EQUIPTMENT pLEASE ITEMIZE WHY THIS AMOUNT IS BEING BILLED & SEND US PROFF OF THIS CHARGE.
Then on 6/22/07 Dish Network charged my Discovery Credit Card the $71.60. We refused to pay and told them the problem we were having. They said they would look into it.
Discovery has now said we have to pay and they sent as a copy of a contract. They sent us a copy.This copy does not have our signature on it.
I have contacted the Larimer County District Attorney and he suggested I contact the Consumer Fraud Division: Consumer Fraud Division @ 1-800-222-4444

Since I wrote this letter I have spoke to three people who have had similar experiences. This is a wide spread problem in Larimer County, Colorado.
