Conn's Appliances Complaint - Over Drafting Account
TEXAS -- I had received a phone call stating a payment was due and was late so I made arrangements to pay it with a post dated check over the phone. The agreement was for 201 and that # was said at least 5 times and I had written it down so I could put the funds in my account that I pay bills out of. Well I looked at my account one day on the internet and it said I was over drafted 100 dollars and that there was a 25 dollar over draft fee. I then contacted Conns and I argued with at least 5 people before giving up. All they said was well it says here in are notes it was for 301 and I kept telling them no it was not it was for 201. They also said the conversation was not recorded and they hardly ever are. I also spoke with a manager and he told me not to call back again. So then what I did was go to my bank and got a copy of my check and at the bottom of the check it was wrote out that all the fees and one extension added up to 201, but the check itself was made out for 301. I was right.
They even wrote it on the check and still denied it. A month and a half goes by and I hear back from them and they had the nerve to ask me for a payment and that I was late I kept telling them I am not making a payment until that is fixed and I still yet have heard from the legal department. They cant face they were wrong and now don't wanna fix it. All I asked was that they put the 100 dollars plus 25 fee I was charged back into my account. They still give me the run around and ask for a payment. Any suggestion on a lawsuit?
