Sears Complaint - Pay Off - Court for 7th Time
This is going to be my 7th time in court with Sears and their attorney. Back in June 2003 I received a phone call from the Sears billing department asking if I would like to pay off my balance, at a lesser amount, since my account was in default. I of course took advantage of it. I first gave him my bank account number then the numbers to 4 different checks in the amounts agreed upon for the monthly payments. He told me to write "VOID" on the checks so that I wouldn't use them again. For the next 4 months the correct amount was taken out and applied, so I thought. After those payments were taken care of, he called me back and asked if I wanted to do that again for the remaining balance but this time it was a lot less because I didn't owe that much any longer. I agreed and did the same thing as last time. Well, 2 years later I receive court papers saying Sears' attorneys are taking me to court for an unpaid balance of exactly what I paid with those checks.
I went to court 6 times (because it kept getting rescheduled) and it was supposed to be settled. Much to my surprise, last week I received another court subpoena for Sears for the exact amount once again.
I would never recommend a Sears card to my worst enemy. They are horrible and a rip off!!!
