Sears Complaint - Sears 15% restocking and delivery charge
In July, 2007, I bought a matching Whirlpool washer and dryer from Sears; in Dec. 2007, the washer stopped working. A repairman came out and tried to fix the washer. A week later Sears picked up the washer .
Since the washer and dryer were purchased as a matching set, Sears said I could also return the dryer. I returned the dryer and washer on the same day. I received a full refund for the washer, but Sears charged me a 15% restocking fee on the dryer! (This Sears store no longer even carries this model of washer and dryer. ) I also had to pay the delivery charge of $85 plus tax.
The amount of my money Sears kept from me was $196.55. Is it legal for Sears to keep my money?
The sales slip I received from Sears says " a 15% restocking fee applies on select Home Appliances ". When I contacted Sears by phone and also by email to clarify for me what those Select Appliances were, they could not tell me. This slip also says "the following items may be subject to a cancellation/restocking fee if returned ". The wording on the Sears receipt is misleading.
Since this was no fault of mine that the washer was defective, I feel I should get back 100% of what I paid for the washer and dryer and that I should also get back the delivery charge too.
I am hoping you can help me get my money back from Sears.
