GC Services Complaint - Getting sick over my debt - Debt collection agency

Debt collection agency - Complaint
Review by Very Upset at GS on 2008-02-19
MBNA was the original name of my account.....I deposited a loan of $5000 to help me pay off 2 of my credit cards.....after I PAYED OFF the two credit cards I began to pay MBNA back $107 monthly we were doing well in paying off our debt until August 2006.....My husband and I just had a baby boy in July of 2006 we couldn't have been happier and everything was going really well until we brought our son home from the hospital after a couple of days he just began projectal vomitting we had no clue as to why went from dr to dr formula to you name it he drank it acid reflux medicine you name it we bought it as all this is going on we're still paying down our credit cards so far we not drowning in debt but getting are feet wet so after all this back and forth to dr's 25 dollars for co-payments up to 20.00 per bottle of neutramagem per can we were starting to get nervous already but still managed to do what we had to do to feed our child and take care of him medically but he was still vomitting even after all the medicine and changes in formula...at this point as a parent your main priority is ofcourse your child... so we finally took our son to a specialist and she tested him to see if maybe he has allergies and ofcourse he does he's allergic to molk, milk protiens and soy....so now what well they put him on this formula called Neocate the Dr said thats the only thing he could drink well I was so happy that they had something for him but the down fall and the financial drowning begins here just go on the web site to see how much this formula cost and guess what our insurance company doesn't cover it so for a family of four with only 600 per week coming in how could we do this and unfortunately we had to stop paying all our bills we were litteraly living pay check to pay check side jobs galore and God only knows how we managed to feed, dress, and live for we were not used to this struggling and my poor daughter who was seven at the time didn't understand why we couldn't go anywhere, buy anything and had to eat pasta all the time......but wait it gets worst I also have my daughter's Commmunion coming up and what do we do.... we had to cancell her party and guess what no deposit comes back to us....and that same day was her reconciliation and right after that we go back to the house feed our son his first jar of baby food and 10 minutes later his face blows up like a balooon and he starts making choking noises we all paniced ran to the ER and thank God we arrived when we did....He was having a severe allergic reaction to the whey in the food... we almost lost him that day May 10 2006 I'll never forget that feeling ever thank God again He's still here with us......So after that we had to get an eppy pen Guess what thats not covered by my insurance either so $300.00 later and definetly worth it digging ourselves into further financial distress still doing waht we have to....just to survive now our son develops a bad rash through out his whole body back to the dr's this time the dermatologist he found that my son has atopic dermititis and sever exima by this point I'm drained and just want my son to be healthy so now to put the icing on the cake he now needs all these special creams which again are not covered by my insurance so $75.00 later further in debt.....We're emotionally drained and heart broken over our son want him to just be healthy and happy.....and the bills just keep on growing all the money that we paid into our accounts are now more then the original debt and can not pay a penny we can't even afford to go bankrupt.....so now all our original accounts are with collection agencies and we called credit sollutions to try and stop some of the intimitating phone calls and they were able to help with some except for the MBNA account which is now Bank of America Who's collection agency is GC SERVICES LIMITED PARTNERSHIP COLLECTION AGGENCY DIVISION and we now owe them $5559.96
the first time they called me I told them exactly everything I just shared with you in this review about my son but with more emotion tears were uncontrollable and my heart was broken to hear the way they responded to my worst experience in my life without a care in the world they proceeded to say they needed the money in 48 hours and didn't care about me not having the money told me I should give my son up for adoption or better yet sell him or even sell my body give my neighbor a BJ .....I was never more insulted in my life I don't know why I didn't hang up on them but I didn't I told them that I had given power of attorny to Credit Solutions and if they had anything else to add to please address them and instead of me hanging up on them , they hung up on me....but to add insult to injury they called my mother and father-in-law trying to get money out of them because my husband and his father share the same name and believe it or not the same birthday.... my father -in law is 84 years old and they told him that his son took out a loan in his name and that if he doesn't pay it back they are going to press charges against his son....and to top it all off the also called my husband's Sister and told her the same story that they told his father and also asked her for the money......until today and I'm sure tommorrow they call and Harrass my in-laws and my self more then 10 messagges per day on all of our answering machines and now my whole family knows our business and ofcourse know one is able to help us......I just don't know what to do anymore my heart is shattered into a million pieces and I'm afraid to answer my phone.....Please help..........

I am very sorry to hear about your son and I hope that everything turns out well, you sound like loving, devoted parents and are doing everything you can for him.

As for your debt, don't ever think a collection agency will care about your problems - they've heard every sob story out there and are trained to not have an emotional reaction - they are there to do a job, collect the money that you owe, and that's it. You may not think it's fair but that's the way it is.

Have you or your husband considered getting a 2nd job for a while until you are able to get these debts paid off?

Good luck!

I'm sorry for your son's illness. I have two boys myself and that sounds so heartbreaking and stressful.
Collection agencies are ruthless. Sadly because they've heard this story and stories like this so many times they honestly don't care how much money you don't have and how sick your child is.
The only suggestion I can make is to have your spouse get second job for the time being. Unfortunately that is the only way you will get these people off of your backs. Once again I'm sorry for your son and I hope he gets better soon. By the way, have they ever tested him for something called pyloric stenosis? I had that when I was a baby and used to projectile vomit everything I ate 15 minutes after I ate it. Next time you go to the pediatrician ask him to check for an olive size lump in the duodenum.

I don't know what state you are in, but I would suggest that you go down to the WIC office and explain your situation. They may be able to help with the food bills a bit (any little bit helps).

Also, please think about trying for medicare for the baby (he may or may not quilify, but you never know).

Good luck!

All of these suggestions are right on point. Also, I would like to let you know that the law says that cridotors can not talk to ANYONE about teh debt, except the person who owes the debt. They CAN cotnact family to get your current address and phone number, but they cannot tell them who they are or why they are calling. They have obviously broken the law, therfore, you should contact your states attorny general and the atorny general for the state the collections agency is in. You can also write them a letter telling them to cease and desist any communication with you.(make sure you send it certified/return reciept)and if they continue to contact you, they will be, once again, breaking the law. I wish you and your famliy the best of luck, and i do hope your son gets better.

GC is a third party collector, therefor you can send them a cease communcations notice they have to adhere to. Credit solutions I assume is a credit counseling agency. They really should be able to help you here. Unless you just signed up, I don't know why you even getting calls as BOA should have pulled that debt back becuase they are being paid now.

Call the Attorney General's office in your State and ask for advice - they can point you to publications, etc that may help you. Be very careful about using another 'loan' company to help you. Many of them prey on the desperate and unwary with big fees and high interest rates.

First off I would like to say sorry to hear that you are having such a hard time and hope everything works out for you son. Now as far as GC services is concerned. I work for the company and I can tell you this much, they have a zero tolerance policy for that type of harrasment and disclosure and will take steps including termination of the collector for that. All you have to do is call the collection office number listed on the letter sent to you and request to talk to an AM or Collections Manager and explain to that person only you situation. They can work with you to either set up payments or get you a settlement amount to resolve the bill. However to get the settlement, which could vary between 10-50%, you will have to show proof of hardship by providing documentation supporting your claim. They then review the information and submit it for approval. However, here is the catch, depending on your availible credit and your credit score, you could be open to a lawsuit in which case you would be responsible for all attorney fees and court cost. So if you and your husband do have a high score and assets, then liquidate your assets and resolve that before it's too late. As far as the contact to your father in law with the same name and birthdate. Collectors verfiy the individual by name and birthdate and even the last four of the social if the first two don't add up, which they did. So that might have been an honest mistake or it could be intentional. Contact depending on the state your in varies and it would be best if you did a search for fair debt collection practices act. You should find some detailed answers there. Other then that, the only other advice I could recommend to you is that you can verbally notify them to cease all verbal and written contact with you and your husband, however before you do that make sure you review your credit score and assets because that can force your account in to the legal office for suit.

GC Services is the worst! They have more complaints than any organization i have ever seen. I dont see how they stay in business, they dont work with anyone and are emotionless people who dont care about anything but collecting your money. The Federal Trade Commission has investigated this company due to their ill debt collection practices. I would file complaint after complaint with the federal trade commission about them if i was you. Make sure it is a solid complaint though. I have had to personally deal with this company and have done the research and looked up the laws they are governed by and they dont follow any of them. Look up the Fair Debt Collection Practices Act. It will outline how companies are suppose to go about collecting on debts. Myself and the debt management company i am enrolled in have filed multiple complaints on this company. What has helped me the most is a little box called the daan module that redirects all my creditor calls to their office. All I have to do is press the star key and hang up the phone. Look them up online maybe they could help you. Its creditalliancegroup.net they are pretty good people. anyways i hope i have helped a little. I use to be in the Marine Corps and my old Sgt used to tell me that knowledge is power. So get on google and educate yourself on your options.
