Triangle Car Wash Complaint - Car Wash Damage To Outside Mirror

Review by PaulB111 on 2008-04-06
HARRISBURG, PENNSYLVANIA -- Don't be one of those thousands of gullible consumers who believe what they read or hear in a tavern. You may be happy to hear that you are all wrong. I too had problems at that car wash. I just spoke with my insurance company. Their adjuster told me that no one can escape liability by merely posting a sign saying they are not responsible for loss or damage or injuries. If this were the case, every supermarket, mall, gas station, sports stadium, etc. would have a sign up saying "Enter at your own risk!"

No one would be safe from damage or injuries caused by anyone. I just called my lawyer and he confirmed what the adjuster said.

Please tell us what the lawyer and insurance adjuster suggested as a resolution. How do you go about getting your mirror fixed? What steps are you going to take next to get the car wash to pay for your mirror? If you go to small claims court, how do you show that the car wash is responsible for the damage to your car? It is hard to find this review helpful just because "a lawyer said so" if you are not going to explain the resolution process.

Obviously your adjuster and attorney are correct. No company can escape liability by merely posting a sign, hense the need to have liability insurance. What exactly happened to your outside mirror? In addition, can you prove the damage happened at the car wash? That will come up in court if you decide to go that way. I assure you.

What the poster states is 100% correct. Ask the motel owners who have had to pony up after a child drowns in their pool that was clearly marked 'swim at your own risk'.

That said, if the car wash can prove 'contributory negligence' by the vehicle owner (e.g. the mirror was loose), collecting can be tough. But, again, the poster is correct. Signs do not impart magical immunity from liability.
