Projection Wholesale Complaint - Projection Depot Delivered A Different Projector Than I Paid For

MCLEAN, VIRGINIA -- In March 2005 I purchased a NEW OPTOMA EzPRO 759 3500 LUMENS DLP PROJECTOR XGA NR and I paid through PayPal $3148.00. In December 2007 during the process of replacing the projector Lamp by OPTOMA it was discovered by OPTOMA that my projector WAS NOT the ONE I paid for but an inferior one.

I was shocked by this discovery and I am seriously thinking to file a suit against Projection Depot, eBay and PayPal.

How inferior was it? Is it a step down model? Because so much time has past, you probably won't be considered for a refund by the company, but it may be worth a shot asking. Honestly, since you could never even tell the difference, there couldn't be much of a monitory difference worth chasing any further now. If there was and you can document enough proof worth suing (probably a small claims venue), leave ebay and pay pal out of it. You'll kill the case as they'll file to be excluded and no doubt win.

It could be the perfect scam. Advertise and deliver an inferior model which is outwardly indistinguishable from the superior model. I'm interested in the price difference (new) between the two models. The OP's situation is much like the poor mook who buys a 'Rolex' and finds out it's a knock-off. I agree with Slim...leave Paypal, and e-Bay out of any legal action. Excellent post/warning!

at time of delivery, it was your responsibility to verify what you were receiving. if after 3 years you discover you did not get what you ordered, well that is your own fault. to much time has passed.
