Harr Toyota - Worcester, MA Complaint - Shady Sales Practices

WORCESTER, MASSACHUSETTS -- I went with my friend for her to buy a car. Being new to the state, she did not have a check with her information on it. Her mother was going to send a check. The salesman, [snip] suggested that I give two checks to hold the deposit, but that these checks would never be cashed. My friend brought her mother's check to the dealer when she picked up the car. She asked for my checks back, but the salesperson said he didn't have them. A month later, they cashed the checks which overdrafted my account causing fees of $66 total. My friend talked to them and they assured her that the matter would be fixed--my checks destroyed, her mother's check cashed, and my fees reimbursed. That did not happen. Two weeks later, they cashed my checks again, overdrafted my account again and I was charged $33 more in fees. My friend gave me another check from her mother to clear up the situation and keep it from happening again.

However, the dealership still owes me $99 for the fees and a stop payment fee for her mother's check and at present--over two months later--nothing has been done.

In trying to do your friend a favor, you wrote checks with insufficient funds to cover them. As I see it, the dealer owes you nothing. Your 'friend' owes you the principle amount of the checks, but not the NSF fees...those are yours.
