EMS Inc Complaint - Fradulent Company Using The "Perfect Scam"
SAINT GEORGE, UTAH -- I received an unsolicited email from this organization promising me guaranteed results to promote my affiliate web sites. After discussing their program I agreed to sign up because it contained a three business day cancellation clause. I was pressured to sign and fax the contract to them, which I did at 4:30pm EST on May 30, 2008. I reviewed the contract in detail over the weekend which was completely different from the sales pitch. I exercised my right to cancel by sending a registered letter and an email to them on Tuesdsay June 3, 2008. They immediately contacted me to tell me my three days expired as they counted Friday(?), Saturday, and Sunday as my three business days. I disputed this claim with them as there business days was not stated in the contract and therefore Monday through Friday were the only legitimate business days. They have refused to discuss this matter any further and my lawyer has advised me that this contract is written in such a way as to discourage law suits.
In addition they told me that my credit card would not be charged until the three days have passed, but in fact was charged immediately. This company has further threatened me for going public about their business practices.
