Spillane General Engineering Complaint - Overpriced; collect funds and NOT pay the sub-contractors; bounce checks to the subs causing a lien to be placed on my property

BURLINGAME, CALIFORNIA -- This company does NOT meet its original cost. It adds fixtures that I did not order, charges me the cost to the sub-contractors then fails to pay them. When I confronted him he said the "checks were in the mail". He took 5 months on a two month job. I found out that he is employed by the CCSF/plummer but fail to disclose this to me.

Now I understand why this job was sooooo costly and took so much time. I have documentation of his failure to meet contract agreements with the sub's; yet he already had $52,000. of my money. He ripped off a retired single lady whose only problem was trusting him. I have now paid approximately $65,000. covering his bounced and unpaid bills and have letters from four of the subs documenting his "lies and nonpayment".

The Contractor State Lic. Board and the Surety Bond Co. have open investigations pending and I have generated a police report stating his actions. Do NOT trust this "likable, Irish man...nothing inside.

In most states an unpaid sub can place a lien on the property. What you need to do is hire a lawyer to sue for damages.

make sure to have the original contract. does it state he will pay the sub-contractors?

Even if it says he will pay the subs, they (the subs) can and will place a lien on the property if they aren't paid by the general contractor. I work for a sub in the construction industry and we have placed liens on property when the GC doesn't pay us. We've even been paid by a property owner when the GC failed to make payments. The property owner sues the GC to get reimbursed.
