Mills Realtor Complaint - Property Management - Prop. Management Service

Review by bizylady on 2008-10-10
SACRAMENTO, CALIFORNIA -- I went into a contract to have this company find me a tenant for my investment property. I understood and verbalize the terms with the agent. The home is newly remodeled and ready to move in. I do the upkeep of premises. No leads or prospective tenants were found, house shown twice within 2 months. The agent decides to terminate his services and send me a bill for his services of ( managing a vacant home!). He breaks the contract. The contract said it would charge a fee for finding a tenant and $85.00 a month to manage it. Well, the invisible fine print was " manage the property while vacant before finding tenant ".

How can this be? He knew I was coming periodically to upkeep the place. Yet, he claims he managed the vacant house. Why would I incur unnecessary expenses? I have had several managers before but none like this one with the invisible fine print.

I would like to find a way to bring this to a legal suit in court. MALE AGENT TAKES ADVANTAGE OF HELPLESS FEMALE. Oh, by the way the agent is holding the key to house and entry card to secured gate until monies are paid?

Sorry, but fine print is not invisible. Verbalizing the terms of a contract is not the same as reading the written terms of a contract.

Sounds like a scam to me. How long was the contract for? Wasn't part of the contract for him to find a tenant? Sounds like he did not fulfill his end of the bargin.
