Central Florida Powersports Complaint - Not Living Up To Prices Quoted

KISSIMMEE, FLORIDA -- On December 13, 2008 I called the above company to find out how much they were currently selling a 2008 Seadoo RXP-X jetski for. I spoke to a sales representative who told me that she would find out call me back. I gave her my phone number and waited about 10 minutes. She called me back and stated to me that they were $6,464. I asked her are you serious she says yes. I tell her that I am located in Miami and asked what time they closed. She informed me that they closed at 6pm. I told her there was no way I could make it there in time to purchase one and asked about Sunday she stated that no they were not open. We agreed on a meeting the following Saturday.

I asked her if it was possible to get a quote emailed to me showing all the prices for tax, tag, freight and what not so that I would know the total prior to driving so far. She said not a problem. She called me about 30 minutes later stating that her boss was still busy and she couldn't email the quote until he was done but that if I went on the website I would see the prices she quoted. I logged on to the site and it was listed there about half way down the page. She proceeded to go over all the additional fees with me and then said as soon as her boss was ready she would email but for now wanted to give me a total to "hold onto".

On 12/17 I get a voicemail stating that there was a pricing error on the website and that the correct price was about $3000 more than listed. I called the sales representative back and displayed my disappointment. She said she would have her manager call me back. About 5-10 minutes later I got a call from Brad (I believe) who stated that yes the representative was wrong and price listed was no the sale price. I told him that it's not what I was old multiple times over the phone and he stated people make mistakes. I pointed out the fact that it's listed on the website and he stated they were covered by some law about misprints. He said if I wasn't happy I could file a lawsuit and have them served otherwise he wasn't going to discuss it any further. If I wanted the jetski for the correct price he'd be happy to talk to me.

At this point I wasn't sure where to file my complaint and saw that they website was "fixed" a few days later so I wrote it off as a truly honest mistake.

Now on 12/30 or so I was online again checking on prices and notice the website again says the $6464 price. I called that day and spoke to a male representative and asked if they had any of the jetski's left. He said he sold one the day before but that he believes he still had one.

I asked him to find out the price total including all fee's and to get back with me. He didn't return any phone call to me. Each time I call I am told that $6464 is the price for the jetski yet they are unwilling to give that price in writing other than what is on the website.

I just want to be sold the jetski for the price quoted of $6464 like listed on the website.

i could not find any jeyskis under 10k on their site. as they did state, they made a price error, and legally, they do not need to honor that.

[snip] You may want to contact the consumer protection office of your state's attorney general. If a business uses a low price to bait consumers with the hopeful that a small number of baited buyers will pay more than the low-ball price advertised...the advertising scheme is illegal as a deceptive business practice.
