My3cents.com - not sure what to do about collection agency

STREET, MARYLAND -- As a consumer from your state, I felt it was my responsibility to bring to your attention the following incident.

Greetings,
First thank you for taking the time to answer my question. I was contacted on 03/09/04 First by a processor who told me he had a civil and crimial summons for me and that he could not tell me the details of them but if i called this phone # 1-866-301-1030
and give them this case# RJS 83 640. So I called and was told that this was for a loan from 1990 and if i didn't pay 1805.95 that night he was going to send the processor out to to serve me with a civil summons and crimial summons for attemp to defruad. I told him this is the first anyone has contacted me about this by phone or mail I asked him to give me some time to talk to my wife about this. So when he called back later that night he said he could make a deal for 900.00 and go after my ex-wife for the reminder.I asked him if he could fax me a statement with the loan info, and he refused
then he said i don't want to make any deal i want the whole thing. I told him i just wanted some paper showing what i owed he told me you owe the debt pay it you know we can garish your wages.I ask him to hold on and my wife the whole time was listeing on the other phone and she said something not right this. I guess he heard her because he hung up. He Called the following day and spoke with my wife asking what papers he needed to fax to get this straight she told him all the paper work he had concering the amout of the loan, he said ok he'd fax it. When the fax came in all it was, was a copy of mine and my ex-wifes drivers lic. and the financial statement of what bills my ex-wife and i had at the time, nothing with any amount of the loan or how much was still owed. He said that he was representing household finance who had bought all of ITT debts. I phoned household and they have no record of this debt anywhere in there files. when we question him about this he said he bought the debt from them.he asked if we got the faxed papers and we said we did but nothing he sent did us any good we wanted something with the amount on it. He informed us that that has nothing to do with what you owe now. He said the amount owed on the loan was 355.53 Plus 450.00 interest Plus 1000.00 for his fee. He called 2 days later and wanted to know if we're going to pay this or not. My wife took the call she asked him for his name Ed Smith his title Gen. Manager
and there address and he hung up. As of 03/16/04 I have not recieve anymore calls and i have not received any mail from them. My question is: Is this legal what they are doing.

nah. just ignore them. they always try heavy handed tactics. get caller id or call block. they love that.

No it is not legal there are no criminal charges for unpaid debt not to mention from 1990. Your wife did right by asking for contact information that is probably why the caller hung up. You may want to check a few things out because this sounds like a rogue to con you. At the very least ask if you can settle this in a courtroom.

This is definately a fraudulant operator on a fishing expedition. Contact the police. Record the calls. If they have your DLs, then they have your SSN, and I wouldn't say you were over reacting if you contacted the FBI for fear of identity theft.

Did this person ever give you a name of the company? Sounds to me as if some con got some info on you and trying to cash in on it. 866 phone numbers are toll free numbers sold for just $20 a month and it sounds like anyone can get one to make it look as if it is a company. Also the number 301-1030 looks like a cellphone number. I agree with the advice of Mr. MadEye and even if you never hear from this person again, you should carry on your investigation on him. Ignor my previous question about the name of the company, I see he stated he reps Household Finance.
