Bank of the West Complaint - The Teller Messed Up My Account Really Bad! - Bank

Complaint
Review by VeryMad on 2009-03-25
SIOUX CITY, IOWA -- I had someone steal my debit card info online so I went into the bank and asked them to cancel my card and reorder another one. I was told all was fine and not to worry anymore. 3 days later I get another unauthorized transaction on my account and was told the teller hadn't shut my card down all the way and thats why the scam people were able to use it again. Not only that she debited my checking and savings for my paycheck when she was only suppose to cash it over the counter and now I'm stuck paying overdrafts fees and debits that shouldn't have been on there.

The girl needs to be fired or trained really well again because she just cost me a lot of money.

Are they refunding the charges caused by their error?

My thought exactly. The OP is not responsible for those charges and needs to speak with the branch manager.

I recently had four unauthorized PayPal charges totally $400 hit a dormant checking account I keep around because my employer notoriously ignores updated banking info and directs reimbursements to accounts based upon previous data. Pinheads. Anyway, those charges resulted in three $17 OD fees. I simply went to my local branch where they had me signed a standard form affidavit stating I did not authorize or have any knowledge of the charges. In like a couple of days or the Paypal charges and od fees were backed out. It was surprisingly easy. Good luck.

If this is indeed fraud, you would not be responsible for the charges or any fees, regardless if the teller forgot to shut your card off. Your bank should also be able to investigate any charges prior to you notifying them your information was stolen and remove those too.

The only reason you would get stuck paying the fees is if the card was not really stolen and the charges were found to be valid.

If you have not already done so, make sure you file a dispute in writing. The terms and conditions for your account you received when you opened the account should have a section in it that explains what to do. Or speak to a teller and tell them you want to file a dispute form. Banks are required to do certain things within a certain time frame after they have received your dispute in writing. It also helps to maintain a paper trail in case there are future problems.

Most banks will place a hold on funds in your account when a check is cashed and not deposited for the amount of the check. That should also be explained in your account terms and conditions.
