FWM Laboratories Complaint - Not So "Free Trial" - Acai Berry Detox

Acai Berry Detox - Complaint
Review by joinmn on 2009-06-24
HOLLYWOOD, FLORIDA -- On June 7, 09, I signed up for the 30 day "free trial" of this product. I received one bottle of "Acai Berry Detox" about a week later, but was charged twice for shipping. I figured it was a small sum, so didn't follow up with the company until today when I logged in to reconcile my check book and noticed a charge for 87.17 on June 21, 09 to a company called "expressberry". I called the number listed next to the charge and was told that they wouldn't refund my money as the "free trial period" was over. Checking the math on that, that's exactly 14 days from the date I PLACED the initial order. Nowhere near the promised 30 day trial and certainly not a charge that was authorized to my account. When I could finally get the "customer service agent" to stop reading from his script and listen to me, he had no clue what to do.

I told him that I hoped the call was being recorded and asked for a supervisor. He put me on hold for a half an hour. I finally gave up and hung up, as I sincerely doubt a supervisor exists and if they do, they obviously had no intention of speaking with me anytime today.

This is so wrong - I will be contacting an attorney.

Call your bank tomorrow, and ask them to return the debit as an unauthorized charge. There is a time limit on this, so don't delay.

Hopefully you now know to *never* give out your bank account information. If you feel the need to purchase online, always only use a credit card. You have much more rights with a credit card than if you give them your account number.

I wouldn't bother with an attorney, their terms are clearly stated on their website:

http://www.acaiberrydetox.com/offer/lp4/terms.html

NOTE: All products come with a fifteen (15) day free trial period (“Free Trial”) as described in this Agreement. If You have any questions about Our Free Trial, please contact Our Customer Service Department toll-free at 1-866-949-0138. Our Customer Service Department is open twenty-four hours a day, seven days a week.

1. Free Trial Policy: Our Free Trial policy requires You to understand certain important dates. The policy, and the important dates for You to know, are as follows:

1. Beginning on the day that You place an order for a product (“Product”) from the Website, Your fifteen (15) day Free Trial period begins (“Free Trial Period”). The Free Trial Period is calculated in calendar days, not business days.

1. You will be shipped a thirty (30) day supply of the Product You ordered. Generally, Your Product is shipped 3 to 5 days after placing Your order. Delivery time is subtracted from Your Free Trial Period, and will reduce the number of days allocated to Your Free Trial Period. If You want to extend Your Free Trial Period due to slow postal delivery or delayed pickup, You must call Our Customer Service Department toll-free at 1-866-949-0138. Reasonable requests (as determined by FWM) to extend Your Free Trial Period generally will be granted.

--------------

That doesn't mean its not a scam, its just a scam that depends upon people who don't read their terms and conditions before giving them their account numbers and order information.
