AUSTIN, TEXAS -- My son had a house fire on 7/3/09 which totally destroyed his home. He contacted Kemper and the adjuster told him it was the holiday weekend and he really couldn't do anything to help him until Monday. All credit, debit and bank access was burned.

The adjuster came on Monday but did not bring a check book. Since the initial meeting they have done everything that is possible to not pay toward this claim. Even to hint that the fire was started by the homeowner/my son and daughter-in-law. They were deposed on Friday 9/11/09 and after a horrible deposition which included an attorney calling my son a liar they were told they now know how the fire started and they were not under suspicion. One of the questions that was asked that the attorney called my son a liar about was he was asked if he ever had an insurance claim. He answered no. The lie that was suppose to have been told was that he was in a car accident at age 18 and was a passenger and was taken to a hospital and there was a claim submitted to my health care agency.

I can't believe they have the nerve to even investigate your health claim. What happened to HIPPA. This had no relevance to this claim.

My son also had the unfortunate hardship of having his company close a 3 years ago. He was unemployed for 1 year and had to declare bankruptcy. THey are now fiancially solvent and they brought their bankruptcy into the deposition and are using it not to pay contents of the home.

NEVER EVER EVER buy a policy from Kemper or Unitrin. There should legislation to protect the consumer. How can you be a victim of a fire, pay for insurance and have the insurance company treat you in this manner. My son said the deposition was the worst thing he has ever been through. Before the company he worked for closed he was a VP of the company. He is business wise and could not believe the maltreatment he was subjected to!

a fire is a general covered loss. whether it occured from a faulty wire or by careless smoking, it should have been covered. the only time they can deny is if it is set intentionally. they were trying to determine fraud. Sorry to hear that he was screwed by a low premium insurance company.

What does the fire marshalls report say?? You should be able to obtain a copy of that.

The Fire Marshall report determined the cause electrical. Today is 10/18/09. The insurance company still has not offered settlement. Fire on 7/1/09. The claim has rumor that it is now on the President of the Companies desk.

This family does not even have winter clothes to wear. All has been tied up. This should be ILLEGAL!

The only problem here is the fact that Kemper Insurance is following up on something that they feel is wrong. I have had Kemper Insurance for many years and I have never had a problem with them at all. The only reason that your son would be brought to this point by Kemper, is because something did not feel right to them. In addition to that the initial adjuster never comes out with a checkbook. They are simply there to ascertain the damage. Think about it this way, when you go see a doctor with chest pain, he doesn’t walk into the exam room and open your chest up until he determines that is what is needed. Same principal. You cannot expect a field adjuster, seeing this property for the first time, and expect them to write a check for it.

Actually when a family does not have a home I would expect a field adjuster to do something. Commercials indicate that we should put our life in their hands. I don't care if it was even money to get a hotel for a few days and food it is providing basic needs for a family that didn't have a check book. When all is lost you would expect that to be the least that an insurance company would do! You can't tell me that they can't have a pre-assigned debit card ready in case something like this happens.

As for the insurance company feeling there is something wrong I disagree with that also. If you do any research you will see that insurance companies all over the nation are doing this practice. Research indicates that the judicial system is coming down hard on companies who stall or provide bad faith service. This is why there are now "bad faith claims". Most of this problem increased after Katrina with the large claims. The problem is that the insured has to go through years of litigation and is the one that suffers. The insurance company officers are not missing a beat in their life. But the victim has had their life as it was known lost to fire. Walk in another shoes. Put yourself in that person's shoes and then comment.

Kemper has nothing to lose by doing this. They gain interest on money that should have gone to their customer. This is now month 5. My son's attorney is ready to litigate. I highly doubt that this will make much of an impact on this insurance company. But this should be illegal.

I will vow that I will pursue this to the highest level in government I can. May this be judicial or legislative ! I will help my son and his family fight this company.

Just an update. Into month 9. Kemper continues to stall. This company is so bad. Absolute confirmation of cause of the fire and they have left no recourse but to file a bad faith claim.
