SAN FRANCISCO, COLORADO -- Back in December I had financed some plastic surgery through them, it has been nothing but a nightmare since. They had opened 2 credit accounts for me, when I only wanted 1. Later, I recieved a letter in the mail that I was being credited back $2,000 and no explanation why. I figure a lawsuit or something had been brought against them and it was a settlement of some sort, but that's just pure speculation. So, I was thinking, great! my balance will be $2,000 less and I can save some money on interest. As it turned out, they credited my ZERO balance account (the second one I never wanted in the first place) with the $2,000 refund. I called the first time on 05/10/04, to have the refund transferred to the other account and was told by their representative that it would be quicker to just have a check sent to me, deposit it into my account and make a payment from that. So, I told them to go ahead and do that then, of which I was assured by their representative that I would recieve the refund within 10 days (I figure he meant business days). I recieve nothing in the mail and call 3 weeks later to find I still have a credit balance on the account. I talk to their representative again and this time I am told that because of the dollar amount, the money has to stay there for 30 days before I can request a refund. I'm not happy about this conflicting information, but at this point, the money has been sitting in the account for almost 30 days already, so I ask him to place a request for the refund be sent to me. 2 weeks later, I call to find I still have a credit balance, (now I'm writing down names), I speak with Ashlee (a customer service rep with very little skill and she argues with me that I cannot request a refund until the refund has been in the account for 60 days. I'm a little pissed by now and ask to speak to a supervisor, after being on hold for 10 minutes, I speak with Ron McLachlan, who states that I have to wait 60 days for a refund, but he assured me he would put down an expedited request for refund. I asked him how I would be compensated for the time they are holding onto my money. Certainly they are making interest on my money, but I will not be paid interest from them, and as a matter of fact, since they credited the wrong account (possibly on purpose), I am paying interest on $2,000 more than I should be. I called again 6 days ago and spoke with Greg who told me the request had been placed and that I should recieve it within 30 days. Today, I got another bill from them with a credit balance still reflecting, on calling the 800 number, my balance still reflects a credit. I am so dissatisfied with this company, I will never again do business with them. I have reported them to the Better Business Bureau and am searching online for a pending lawsuit I may be able to join. It seems, that all these representatives give different conflicting information. Their calls are recorded and they even gave me the dates I called them. It seems that what their representatives tell the consumer, being that they represent the company, should make the company responsible. When I am told I will recieve a check within 10 days, or 30 days, this creates a verbal contract, which if I am correct is legally binding in the state of California. If anyone knows of any class action lawsuits against these guys for anything similar to my situation, please let me know... and sorry for this being so long.

I am also involved in a dispute with GE Capital. I am also interested in forming or joining a class action suit against these people. Have you had any luck or any response from anyone. I am in the process of turning them in to the Attorney General in several states and the BBB. They are in clear violation of the Fair Credit Billing Act.
