Encompass Insurance Complaint - Encompass Insurance deceptive practices

Review by rogerdsl on 2009-10-24
CARROLTON, TEXAS -- On Oct 17 2006 I was rear ended in Montgomery County Texas by a minor, 16 year old Russian girl driving a brand new Volvo S40.
Her insurance was with Encompass Insurance (a mask for All State).
They sent me a check for $200.00 and repaired my Mercedes Benz car with $1300.00
When received the medical bills they declined to pay.
I took the case to the Small Claims Cout Justice of the Peace No 3 (Judge Edi Connelly).
To my disbelieve the attorney for the Insurance company convinced the Judge that I did not complied with respond to their interrogatory despite that I had the USPS ticket to prove otherwise.
The attorney Michael Simcoe, lied to the Judge indicating that I was not in compliance despite that I attended a deposition to answer his question with an stenographer present.
The Judge ruled the case in favor the Insurance company despite that I was rear ended and non moving at the time of the accident since I was waiting for a red light!
When I contact these people they claim that the case was closed and threaten me with legal action if I continue contacting them (!)
These people have made a mock of the Judicial system.
Judge Connely, who is not an attorney, rules in favor of the party with an attorney since she feels insecure to stop them and basically goes with the flow.
Anyone who represents him/herself at the Justice of the Peace Precinct 3 has lost the case in well in advance
I was left with thousand of dollars in medical bills, car repaired under sub standard conditions and a bitter sense that may be we are not equal after all under the Law (which is the worst)
