I loaned my GMC truck to my son, he took off with a woman and was gone for approx 2 months. I did have the police looking for him and I was looking for him myself. I would have taken my truck if I found it. Oct. 23 he called me "thanks for taking the truck" and hung up on me. I did not hear back so I called Balt. police and found it had been towed after a hit and run on the 26th. I called my insurance agent and was told to have it towed to a body shop. I got a call from an investigator and met her a the body shop. She was rude and threatening in her manner. They refuse to consider the vehicle stolen and want to pay me approx $1100 less 500 deductible. The body shop seems to think the truck is totaled. I have been thru hell but they have finally agreed to make a more thorough investigation. I don't expect to get a fair answer from them.

My agent is [snip] in Salisbury, Md. He has been no help and I cannot even get a call back. I have called the De. insurance commission. We will have to see where it all goes.

It might be worth $100 or so to get 1/2 hour with a lawyer who specializes in auto insurance to help you out with knowing your rights in the situation. I'm really not sure how legally it's going to be interpreted when you loan it to a family member who doesn't return it (i'm thinking stolen but not really certain on that one).

Good luck with it. Let us know how it works out. Sorry your kid has treated you so badly.

What your son did is called conversion. Regardless of whether or not he stole it, your company owes you the cost to repair the vehicle or its actual cash value, so I don't see why they felt the need to sic an investigator on you. And your agent? Fire him. That's inexcusable not to return your call.

I think you should hold your son responsible for everything you are going through. Why should you get stuck with everything??

Why are you letting him off the hook?? Also the insurance company has every right to not consider it stolen, you, yourself said you loaned it to him. Even though you say he was gone for 2 months, you still had lent it to him. Again, let him pay fof this mess he caused.

My instinct says the same thing, skelly. I'm pretty sure they insurance is going to come back and say "why didn't you declare it stolen/converted to us before it was in the accident," "are you only now saying it was stolen because it was wrecked" or something like that. I can see how it would get messy.

Did you actually report the truck as stolen or just ask the police to look for your son? Are you pressing charges against him for theft of the truck?

Thank everyone for your comments and help. I did go to the police re: my son being gone with my vehicle and because I had agreed to sell it to him they considered it a civil matter even though it was only a verbal agreement. He had the truck taken from him on the 23rd accident was the 26th. probably taken from him by one of his worthless acquaintances. I have asked Nationwide to reopen the investigation to place definite blame. If my son was involved, he should be charged.

did you file a police report for a stolen vehicle after the truck was taken? also, if you gve the keys to the driver, most insurance agencies wont cover it as a stolen vehicle.

ANYONE can drive your car with your permission and the insurance will cover the vehicle. Since you let your son take your truck, you gave permission. This is no considered theft. The insurance will cover the car under collision coverage. There is no coverage under comp. (theft)
