Perfection Sudbury Painting Complaint - Fraudulent Contractor

Dear Mr. DiStefano,
Over the past couple of weeks we made several attempts to reach you over the phone, but still have not received any response from you regarding our reimbursement of $700.00.
This money was paid as part of your overall proposal of February 14th, 2004. Payment for which you have received in time and in full. We understand and appreciate the fact that due to your illness, you were not able to perform the refinishing work on our hardwood floors at our residence in Maynard, MA as reflected in the agreement mentioned above. Accordding to a voice mail you left for us on June 25th, 2004 and the subsequent phone conversations with my wife, you agreed to reimburse us for this part of your proposal. In fact, you claimed to already have mailed a check for that amount.
Meanwhile, our floors have been refinished by another contractor, as agreed, but we still did not receive the reimbursement from you. With this letter, I am notifying you to send us these $700.00 until Friday, August 6th, 2004. Should we not be in receipt of our money by that time, we will take legal action in order to secure our funds.
The letter was sent to Mr. DiStefano's last known address at 738 Main Street, PMB 196, Waltham, MA 02451. His letterheads specified two other addresses, but they were both no longer valid. Having read the other publishings on Mr. DiStefano and his businesses, I felt it was time to share this information.
To this day we have not received our money and are preparing to file suit against Perfection Sudbury Painting and Mr. DiStefano. By the way, Perfection Sudbury Painting (also known as MetroWest Painting) is not a registered business. As in all the other cases on this website, all checks were made out directly to Mr. Distefano.
Also, we filed a complaint with the Better Business Bureau today. The complaint (case #101807) was immediately rejected and closed with the following auto response:
"Unfortunately the Better Business Bureau is unable to present your case to the business. It is outside the scope of BBB mediation and arbitration services. Your complaint will be placed into a permanent company file as reference material for future use. In most instances we have also informed the company of your dispute but have not requested them to respond to us.
