Direct Energy Complaint - Never a customer of Direct Energy and being billed for services

Complaint
Review by amy.pah on 2009-12-29
I am not and never have been a customer of direct energy. I received a letter from a collection company for 653.00 on behalf of direct energy. I made several calls to DE to straighten this out, and a supervisor was never available to help me. a complaint was logged with the resolution department. I have never heard back from them. in the meantime, I am in collections for a debt that is not mine. my credit has been damaged and DE just doesen't care enough to return my calls. they either have the wrong person or they allowed someone to open an account in my name (identity fraud) either way, I'm in a situation that they will not address. this company is awful. they have moved in my state (Pa) and to my fellow Pennsylvanians, stay away from them.

File a dispute with the credit agency. Make them prove the debt.

Send the collection agency a letter (certified, return receipt) demanding proof the debt is valid. I think they have 30 days from their receipt of that letter, to provide you with proof.
Also, see if PA doesn't have a state agency regulating utilities. Maybe they can help, at least to get Direct's attention.

Do they have your SS#? Did you check to see if this is on your credit report, because I don't believe they can place something on your credit report without your $$#...they can't do it one same name only basis.

I'm wondering if this is the kind of company that sends those little cards to people, stating they are going to switch them over to their service, UNLESS they send the card back by a certain date to opt out. I get those all the time for my Electric company and I hate those. Even if that is the case, they should have been sending you some monthly bills before it got to the point of collections. Then again, even if they did send bills, you may have just thrown them away, thinking it was junk mail.

Anyway...as stated above, send them a 'validation of debt' request....you can find a link on my blog with the letter, fill it out with your info and send it certified with return receipt...and as said, they have 30 upon receiving your request to get all the information to you. If you don't get it within 30 days, they will be violating the FDCPA. This is why it's important to send the request Certified with return receipt, so you have record of when they got it.

Good luck and keep us posted.
