OLD SAYBROOK, CONNECTICUT -- I order flowers for my father’s memorial service on 2/21/10 to be delivered by noon. I got a phone call from the company saying they could not deliver the order at the same time the service was starting.

Because of this short notice I had no other way to order flowers for the service because of the late notification.

The company only apologized for the nondelivery and said they would refund my money.

This company was negligence in for filling their contractual obligation and their response was an apology and refund. An apology and refund did not rectify the problem. They should of notified me in time to use a company that could of delivers the arrangement in time.


DO NOT USE THIS COMPANY - THEY DO NOT CARE ABOUT THEIR CUSTOMERS.

No offense, and sorry about the loss of your father, but why in the world would you use a .com flower service for something as important as a funeral when you could go to the local florist and have them do it for you? It's my understanding these places farm the work out to other florists anyway. I'm not being mean, I'm asking a question.

Since you are characterizing this as a contract (which it is), you have to understand that the apology and refund actually did rectify the situation. Contractual remedies are designed to give put the damaged party in exactly the same place as they were before the breach. In this case, a refund did that.

Losing your dad is rough. Been there myself. Chances are, no one is really going to remember who did or did not send flowers. The entire event is a blur. You might want to give a donation to a charity in your father's memory. It'll do a lot more good than some flowers which will wilt in a few days.

My major complaint is that they did not notify me in time to make other arrangements. That is why their remedies are not satisfactory.

As to why I used the online service is that most online companies are good companies.

It's a very valid complaint, just not from a contract standpoint. You have to be a bit careful collapsing contract complaints in with customer service complaints. It's clearly a complete service failure, and from a service standpoint, they need to do something else to make it right. From a contract perspective, they've done what they had to under the law.
